TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> a a TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> rgg CA- <br /> RE : Petition of Sanford Mass 6 Donald Forte for a Special Permit <br /> Case #SP-85-11-064 <br /> A Petition was filed by Sanford Mass 6 Donald Forte both of Hyannis , <br /> Massachusetts for a Special Permit for permission to operate a sales <br /> and/or rental business of televisions , radios , videos and/or audio <br /> tapes : Proposed sale/rental , tapes/films shall not include films with <br /> an "X" rating . Property is located in a C-1 zoning district at Deer <br /> Crossing , Building D, Shop 23B, Route 28, Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation ,in .the Town <br /> of Mashpee on October 30 , 1985 and November 6 , 1985 a copy of which is <br /> attached hereto and made a part hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, November 13 , 1985 , at 7 : 30 p .m . at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> William Hanrahan, Manuel - Costa , and Michael Makunas . <br /> Mr . Kirrane explained that they wish to conduct a retail business , <br /> in a retail shopping center . The type of business is a retail business <br /> that will provide for the sale of television equipment , radio equipment , <br /> video equipment as well as the accessories that accompany the various <br /> equipment that will be sold on the premises . They precluded the adult <br /> or "X" ,rated material , which had been a major concern of this Board ons <br /> the original application. <br />
