BOX 1108 <br /> P�jg (p MASHPEE, MA 02649 <br /> DECISION <br /> RE: Petition of, John Sullivan for a Variance Case #V-87-05-049 <br /> I <br /> A Petition for a Variance was filed by John Sullivan of Mashpee, <br /> Massachusetts for a Variance from the provisions of Section 11A of the <br /> Zoning By-Law to construct a house within 100 feet of the Mashpee River. <br /> .Locus is lot 14 shown on a subdivision plan approved by the Mashpee <br /> Planning Board over twenty years ago. This lot borders the Mashpee <br /> River and a portion of it is located in the Mashpee River Protective <br /> district with the remaining porti.on being located in the Residential 3M <br /> District. <br /> The Mashpee River at this location is very shallow. It is approxi- <br /> mately 12 inches deep. It is a fish run for alewives and brook trout and <br /> has received Conservation attention from the Town over many years. This <br /> particular location has been the subject matter of Conservation Commission <br /> and D.E.Q.E. intervention due to siltation of the River caused by erosion <br /> from lots 14 & 15. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> May 13, 1987 and May 20, 1987, a copy which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on May 27, 1987 at which time the following <br /> members of the Board of Appeals were present and acting throughout: Michael <br /> Makunas, William Hanrahan and Thomas Sexton. <br />
