MA 02649 <br /> DECISION <br /> RE: Petition of Maurice Zabarsky & George Darcy for a Special Permit Case <br /> #SP-87-06-058 <br /> A Petition was filed by Maurice Zabarsky and George Darcy of Mashpee, <br /> Massachusetts for a Special Permit for permission to construct a timber pier <br /> with gangway and float in a R-3M Zoning District on properties located on <br /> lots 143 & 144 Waterline Drive South, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> May 27 & June 3, 1987, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, June 10, 1987 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Manuel Costa and Cheryl Hawver. <br /> Information was received that the pier will be utilized by owners of <br /> lots 143 & 144 and has been incorporated into the deeds of both landowners. <br /> The Board learned the dock will extend 156 feet and will incorporate a 3x14 <br /> foot gangway. "Authorization in writing was received from New Seabury for <br /> construction of the dock however prohibits either lot owner from construct- <br /> ing additional docks. Recommendations were received from the Shellfish and <br /> Conservations Commissions of Mashpee. The Mashpee Planning Board recommended <br /> adequate drainage be maintained. <br />
