The approved landscape, parking and plot plan, which <br /> shows landscaping parking spaces, traffic flow, ingress <br /> and egres_`s from and to Route 28 and the area of the <br /> proposed flea market use shall be followed by the appli- <br /> cant in all respects and prior to open'. rig for business, <br /> the applicant is to notify the Building Inspector in <br /> writing, and he will review the site and authorize appli- <br /> cant, in writing, to open for business if all conditions <br /> contained i ';;the landscape, parking and plot plan and in <br /> this decision, have been .complied with or satisfied. <br /> 2. In lieu of immediate completion of landscaping and <br /> other improvements as shown on the plans, the petitioner <br /> may post a bond with surety approved by the Board of <br /> Appeals or cash surety, in the amount of $1,000.00 in a <br /> form acceptable to the Board conditioned upon the com- <br /> pletion of all landscaping not later than three (3) <br /> months from the date of issuance of the occupancy per- <br /> mit by the Building Inspector. The bond shall be filed <br /> with the Board within two (2) weeks of the issuance of <br /> the building permit. When landscaping and the improve- <br /> ments are completed, as certified in writing by the Build- <br /> ing Inspector and accepted by the Board, the cash surety <br /> shall be returned to applicant. The cash surety will be <br /> held by the Town Treasurer. <br /> 3. The applicant must comply with all State and County <br /> and Town Health laws and regulations in the operation <br /> of the flea market. <br /> 4. The applicant will provide a police officer during <br /> the hours of operation on Saturdays and Sundays at the <br /> applicants expense to control traffic and parking on <br /> the state layout of Route 28. The police officer will <br /> control on site parking and the movement of traffic on <br /> and off the premises. . The Chief of .Police will have <br /> the discretion of requiring that the officer be present <br /> during any other hours of operation. <br /> 5. The house of operation of the flea market shall be <br /> within 7 a.m. to 9 p.m. each day of operation, except <br /> that vendors may perform necessary setup work from 6 <br /> a.m. to 9, a.m. . <br /> 6 . No structures of a permanent nature are to be con- <br /> structed, erected or caused to be placed on the property. <br /> All structures, devices, equipment and other gear placed <br /> on the property for use in connection with the flea market <br /> are to be removed at the conclusion of each day' s operation. <br /> 7. Up to 25 vehicles may be stored or left on the pro- <br /> perty between the hours of 9 p.m. and 6 a.m. of the follow- <br /> ing day in an area located behind Pickwicks Restaurant <br /> building as designated on the site plan. At no time are <br /> any vehicles, trailers, campers, tents, mobile homes, or <br /> other similar devices to be used for human habitation or <br /> sleeping during the hours of 9 p.m. to 6 a.m. . <br />
