MA 02649 <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Melvin & Marcella Bradshaw for a Special Permit <br /> Case: SP-88-10-095 <br /> A Petition was filed by Melvin and Marcella Bradshaw of Dover, <br /> Massachusetts for a Special Permit under Section 6.3.1.9 of the Land Use <br /> Requirements for permission to construct a wooden dock with two floats <br /> in an R-3 zoning district on property located at 58 Popponesset Island <br /> Road (Map 106, Lot 25) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on November 16 and November 25, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, November 30, 1988 at 7:30 p.m. and continued on January 11, <br /> 1989 at which time the following members of the Board of Appeals were <br /> present and acting throughout: William Hanrahan, Michael Makunas and <br /> Cheryl Hawver. <br /> The Board was informed that the Applicant proposes to build a 70' dock <br /> on Popponesset Bay. Comments were received from abutters in opposition to <br /> the size of the dock. Comments were received from the Shellfish Warden <br /> who stated that shellfish beds in the area would be disturbed by the pilings <br /> and that ice damage to other pilings in the area have resulted in damage to <br /> the marine environment. Comments were received from the Conservation <br /> Commission who considered this area the wrong habitat for a dock. <br /> l ' <br />
