SP-88-09-071 Page 3. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on September 28, 1988 to grant the Special Permit subject <br /> to the following conditions: <br /> 1. All plans would comply with restrictions imposed by the <br /> Board of Health; <br /> 2. That there be no time-sharing or interval ownership program <br /> associated with the project; <br /> 3. The property would not be converted to a condominium form of <br /> ownership without the consent of the Board of Appeals; <br /> 4. That the units not contain kitchens or kitchenette facilities; <br /> f <br /> 5. That the combined seating capacity of the restaurant and <br /> function room be 100 persons; <br /> 6. A landscaping bond shall be posted with the Town Treasurer <br /> in the amount of $85,000.00. Once landscaping has been <br /> completed and found to be in compliance the Board shall vote <br /> to release said bond; <br /> 7. A paving bond shall be posted with the Town Treasurer in the <br /> amount of $75,000.00.
