,6 <br /> III _ COMMONWEALTH OF MASSACHUSETTS <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> CERTIFICATE OF COMPLIANCE <br /> This matter was brought before the Board of Appeals of the <br /> Town of Mashpee at a duly advertised Public Meeting on <br /> Septerber 28, 1988, pursuant to Paragraph 30 of a "Decision of <br /> the Bcard of Appeals on Petition to Modify Special Permit" <br /> ( "Decision" herein) dated January 29, 1985, which Decision <br /> modified Special Permit dated March 5, 1974, and which Decision <br /> permitted the issuance of a Special Permit to construct a planned <br /> retirement community in accordance with Master Site Development <br /> Plan referenced in said Decision. Said Paragraph 30 of the <br /> Decision requires the Applicant to file with the Zoning Board of <br /> Appeals for its approval, a copy of the Final Site Development <br /> Plan for each phase to be constructed. <br /> There was at said meeting presented to the Board a Final <br /> Site Ceve_cpmeat Plan for Phase II, which said plan is entitled: <br /> Prel_rninary for Phase II Southport (formerly Pine Hills <br /> Estatas ; , Mashpee, Massachusetts, which said plan is dated <br /> ..August 11, 1988 ( "Final Site Development Plan" herein) . .Said <br /> :.plan was prepared by E.J. Flynn Encineers , Inc . Said plan was <br /> a.-ren_�ed by re-rision sketch dated September 28, 1988, which <br /> revisions was incorporated in the Final Site Development Plan. <br /> Prior to consideration of seep plan, applicant requested a <br /> Modifi_ation of the Special Permit to permit the alteration of <br /> Phase lines , with the result that Phase II would include portions <br /> or all of the original Phases III and IV, is shown on the Master <br /> Site D?veiopment Plan approved January 29, 1985 . The Board voted <br /> to permit said Modification. <br /> After duly advertised public hearing, and discussion of said <br /> plan with Michael A. Dunning, Attorney for Applicant, <br /> Mr. Fitzgerald, of E .J. Flynn; Engineering, Inc . , and Walter <br /> Yares , Architect, the Beard of Appeals, in accordance with <br /> Paragraph 30 of said Decision, approves said Final Site <br /> Develcpmant Plan, and forwards its endorsement therac= to the <br /> Planrig Board with its full recommendation. <br /> Ware the Final Site Development Plan for Phase II, as <br /> approved by the Board of Appeals, differs from the Master Site <br /> Deveizzmant Pian and the recision referenced above, the said <br /> Final Site Development Plan referred to above shall govern. <br />
