MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Re: Petition of John Pastuszak for a Variance V-89-03-39 <br /> A Petition was filed by John Pastuszak of Hingham, Massachusetts <br /> for a Variance for permission to vary the lot coverage and setback <br /> requirements in an R-3 Zoning District on property located at <br /> 7 Wilson's Grove (Map 118, Block 101) Mashpee, Massachusetts. <br /> (Legal lots 216, 218 and 220 on a subdivision plan 6811-D filed with <br /> Certificate of Title No. 578 and Lots IH, II, IJ, IK, IL, IM and 3B <br /> as shown on plan number 11408-5 with Certificate of Title No. 6172.) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee, on April 24 and May 1, 1989, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, May 10, 1989 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Cheryl A. Hawver and Michael A. <br /> Makunas. <br /> Mr. Pastuszak presented plans of the lot and the proposed plan <br /> of the house. He explained that the shape of the lot created a <br /> hardship in placing the house and meeting setback requirements. <br /> He stated that the lot was the largest in the area. He reviewed <br /> plans to have an existing cesspool removed and a new septic system <br /> installed. The lot will have Highwood Water Company service. <br /> Douglas Boyd, Building Inspector, commented that front setbacks in <br /> the area had been, 25 feet. Eight letters were received from abutters <br /> in favor of the Petition. <br />
