C
Cl
BOARD OF APPEALS
Drew Realty Trust (cont.)
Minutes - May 10, 1989
Page 2.
Attorney Kevin Kirrane represented the Petition. He reviewed the
discussion at the hearing of 4/26/89 when the Board had questioned the
lot coverage of the house. He said the owner had modified the design,
eliminated decking and reduced the lot coverage to 20.6%. The dwelling
has been moved to 21' from road at Conservation Commission request.
Ms. Hawver moved to grant the Variance permitting lot coverage of
20.6% and a front yard setback of 21'. Mr. Halpern seconded. All agreed.
Michael Scolavino - (Owner of record: Herbert A. and Jean T. Swanson)
Requests a Special Permit under Section 6.3.I.9 of the Land Use Regulations
for permission to construct a dock in an R-3 Zoning District on property
located at 79 Seconsett Island Road (Map 119, Blocks 101 and 102)
Mashpee, MA.
Members sitting: W. Hanrahan, C. Hawver, M. Makunas
Christopher Costa represented the Petition. He presented plans for
the repair of an existing bulkhead and dock and explained that new pilings
would be installed with no change in size. He said he expected minimal
damage to shellfish but would possibly put in new quohogs in the dock
area.
Mr. Makunas asked if owner had original dock permits and Mr. Costa
replied that he was unable to locate them. 'The dock was built 30 - 40
years ago before permits were issued.
Paul Somerville, Shellfish Constable, stated that the Shellfish
Commission does not object to repairs to pre-existing docks.
Conservation Commission had been contacted and had no comments.
Mr. Makunas moved to grant as requested. Ms. Hawver seconded. All agreed.
Lloyd Gainsboro - (Advisement from April 12, 1989 meeting)
Members sitting: C. Hawver, M. Makunas, E. Govoni
The Board reviewed a memo from Douglas Cameron of Braman Engineering
dated 4/20/89 and revised plans for a stairway, pier, gangway and float
dated 4/19/89. The new plans reduced the size of the float to 6' x 20'.
Paul Somerville, Shellfish Constable, stated that the reduction in
size was a compromise to protect the eelgrass beds and he had no objections.
He also stated that the area in question was not in the A.C.E.C. area.
Mr. Makunas moved to grant the Special Permit based on Braman Plan
E-386 revised 4/19/89. Mr. Govoni seconded. All agreed.
