• <br />BOARD OF APPEALS Minutes - May 10, 1989 Page 3. <br />Mary Krizik - (Advisement from March 8, 1989 meeting) <br />Members sitting: C. Hawver, M. Makunas, E. Govoni <br />Ms. Hawver reviewed the plans and the petition to convert lower level <br />space to a guest apartment including a full kitchen. No comments were <br />received from abutters. <br />Mr. Makunas stated he would deny the petition since he thought it did <br />not meet the requirements necessary for a Special Permit. He was of the <br />opinion that the conversion of the property to a two-family home in a single <br />residential district would be a detriment to the neighborhood and derogate <br />from the intent of the By-laws. <br />Mr. Govoni moved to grant the Special Permit. Ms. Hawver seconded. <br />The motion did not carry since there was no unanimous vote. The Petition <br />was denied. <br />Riverbend Realty - (Advisement from January 11, 1989 meeting) <br />Members sitting: W. Hanrahan, C. Hawver, M. Makunas <br />Mr. Halpern stepped down from the Board for this hearing. <br />Mr. Hanrahan reviewed the Petition appealing the Building Inspector's <br />• decision regarding signage at the premises located at 100 Great Neck Road <br />North (Map 45, Lot 3) Mashpee, MA. <br />He read a letter from Town Counsel dated February 6, 1989 stating <br />his opinion that the Building Inspector was correct in issuing a violation <br />notice on the sign at Riverbend in view of the fact that the sign is <br />currently unlawfully situated within the Town layout of Great Neck Road <br />North, and must be moved to the owner's property. <br />Ms. Hawver stated that the sign had been altered in the past ten years. <br />Mr. Makunas discussed an earlier meeting of the Design Review Committee <br />when it had been indicated that the Riverbend sign would be changed to <br />conform with the signage by-laws. <br />Mr. Boyd stated that under the State building code any change in a <br />sign constitutes a modification and grandfathered protection is lost. He <br />read from the by-laws: "in order to get a building permit any sign, <br />after 1985, over 20 square feet requires a Special Permit from the Board <br />of Appeals". <br />Mr. Hanrahan asked when was the last time the current owner of Riverbend <br />had the legal ability to secure the proper permits or approvals. <br />Mr. Makunas stated that the sign came before the Town when the owner <br />came to Design Review with plans to move the sign on to the Riverbend <br />. property. Mr. Boyd stated that two signs had been approved -- one in the <br />Riverbend area and one in the cottage area. <br />
