Board of Appeals W. Bradford Wheatley V-90-47 2, <br /> The Board of Appeals, after carefully considering all of the facts <br /> and evidence submitted at the hearing, determined that the petitioner <br /> failed to meet the conditions necessary for the granting of a Variance. <br /> There was not sufficient evidence presented that there were circumstances <br /> affecting the land which would cause a literal enforcement of the By-laws <br /> to result in substantial hardship and there were no conditions shown <br /> which were unique to this particular parcel in this zoning district. <br /> The Board did not find that desirable relief could be granted without <br /> detriment to the public good or derogating from the intent and purpose <br /> of the By-law. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on May 23, 1990 to deny the application with prejudice. <br /> BY: <br /> MASHPEE BOARD OF APPEALS <br /> TO DENY: <br /> h Cher Hawver <br /> "LEGAL NOTICE; h / <br /> pTowoetMaehpee, .,,,.
