MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Pamela E. Terry for a Special Permit SP-90-23 <br /> A Petition was filed by Pamela E. Terry (Owner of record: <br /> Michael A. Dunning TR) for a Special Permit under Sections 174-25.B. 14 <br /> and 174-17 of the Zoning By-laws for permission to construct a miniature <br /> I golf course in a C-2 zoning district on property located at 60 Falmouth <br /> Road (Route 28) (Map 55, Block 9) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 12 and February 19, 1990, a copy of which is attached and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, February 28, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Attorney Kevin Kirrane represented the applicant. He presented <br /> plans for a miniature golf course with 51 parking spaces and a <br /> right-turn-only entrance and exit to Route 28. He informed the <br /> Board that the lot has no direct access to Route 28 and he has applied <br /> to the State for curb cuts which would be shared with an adjoining <br /> restaurant. <br /> Letters were received from abutters in favor of the Petition. <br /> Correspondence was received from a direct abutter expressing <br /> concern with the number of parking spaces and suggesting an increase <br /> to four spaces per hole. The Board received a Petition signed by <br /> 23 Concerned Citizens of Mashpee opposing the miniature golf course <br /> due to traffic problems, appearance and excessive lot coverage. <br />
