MA 02649
BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
RE: Petition of Fields Point Limited Parnership for a Special Permit
SP-90-01-08
A Petition was filed by Fields Point Limited Partnership of Mashpee,
Massachusetts, for a Special Permit under Section 174-25.D.2 of the Zoning
By-laws for permission to construct a medical office building in a C-1
zoning district on property located at 51 Nathan Ellis Highway (Map 74,
Block 35) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on December 22 and December 29, 1989, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town Hall
on Wednesday, January 10, 1990 at 7:30 p.m. at which time the following
members of the Board of Appeals were present and acting throughout:
Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan.
Douglas S. Stoors of Fields Point Limited Partnership represented
the Petition and reviewed plans for a medical office building which
would be built in two phases. The -first phase would be a 15,000 square .
foot two-story building with an adjacent 2500 entrance building and the
second phase would be a similar 15,000 square foot two-story building
on the other side of the entranceway. Plans were revised to provide
access for the Fire Department to three sides of the building.
The Board of Appeals made the following findings:
1. The proposed use will not cause excessive demand on community
facilities. Since this is a commercial project, it will create
no increased demand on the Mashpee School System. Highwood .Water
Company will provide water to the project and sewage will be
treated at the Petitioner's wastewater facility. Demand on other
public services, such as fire and police, will be comparable to
other commercial developments and not excessive.
