I <br /> 15 <br /> Board of Selectmen <br /> Minutes <br /> December 17, 2001 <br /> NEW BUSINESS: <br /> Request for Leval Opinion—Affordable Housing Committee: <br /> Tom Fudala, Town Planner was present to ask the Board to support his <br /> request for a legal opinion regarding certain tax taking lands and <br /> assistance with preparation of Town Meeting articles. <br /> Mr. Fudala indicated that he has been working with the Housing Authority <br /> Director and Affordable Housing Committee on a proposed exchange of <br /> land with a prospective 40B developer. <br /> Mr. Fudala indicated that the parcels proposed to be transferred by the <br /> Town were taken for taxes in the last ten years. A draft memorandum to <br /> Town Counsel dated November 28, 2001 outlined the proposed land <br /> exchange. The parcels are listed on the current Assessor's Maps <br /> referenced as Map 93, Blocks 6, 7, and 9 and Map 94, Block 7. <br /> Motion made by Selectman Marsters to allow the request for a legal <br /> opinion and legal services as referenced. <br /> Motion seconded by Selectman Green. <br /> VOTE: 4-1. Motion carries. <br /> Selectman Leveille in opposition. <br /> Donation of Land to Conservation Commission: <br /> The Town Planner informed the Board that in March of 1999, <br /> approximately 18 acres of land located on Back Road, north of the <br /> Briarwood neighborhood, was deeded to the Town. It was unfortunate <br /> that the Town was not made aware of the deed and proper procedures for <br /> acceptance were not followed. <br /> It was noted that the land is in the Mashpee National Wildlife Refuge and <br /> contiguous with open space owned by the Briarwood Association and the <br /> Orenda Wildlife Trust. It is appropriate that the land be held by the <br /> Conservation Commission. <br />
