Jonas signed the plan on behalf of the Bnard and Mr. <br /> Devaney paid the balance of $15 which was owed. They will fix the plan <br /> as they had the incorrect total number of frontage on Janes Circle . <br /> Watersed e - Atty. Kirrane appeared before the Board representing Daniel <br /> Hostetter, e said Mr. Hostetter is proposing to develop open space de- <br /> velopment subject to Spation 9 of the zoning by-laws and having 3 units/acre . <br /> The land is 70.9acres with Zoo ' of frontage necessary to go Forward . They <br /> are proposing 135 2-bedroom units . He said they have 54.7 upland acres , <br /> 15 .8 acmes of og and 14 wetland acres and would be allowed up to 165 <br /> units . They're providing 103 garage spaces . He said he is before the <br /> Board for a pre-application' conference to confer with this Board and others <br /> to provide input to allow them to procede further because it 's an expense <br /> to go further without it . Iie said he 's received ]deports from the Town <br /> Planner and from the Barnstable planner but he didn't see Mr . Rowley's <br /> report yet . He said he 's prepared to address some of these issues as the <br /> pre-application stage is for the Board and other boards to make comments <br /> thea try to plan accordingly. <br /> They went over Mr. .zdala 's memo and the issue of access constituting a <br /> subdivision. Atty,# Kirrane said he spoke to the Town Counsel for the Town <br /> of Barnstable and he disagrees with what the Barnstable Planning Board <br /> says . Atty. Kirrane said the road already exists and if paving constitutes <br /> a subdivision is question to be addressed . For 2001 frontage on a road <br /> they will be constructing solely in Mashpee and it will be done according <br /> to rules and regulations , <br /> nv discussed Mr. Rowley's report . Mv%M . Dubin said the Board was in <br /> agreement that it lows like, the units are too close to the bog and thi} <br /> pond . Nlr.. Rowley said in to rs of proximity to S ntuit PeNn. d , he was looking <br /> at in terms of aesthetics , and the proximity to the bogs created a potential <br /> problem with herbicides and pesticides . <br /> Atty. Kirrane said the concern- of the elevation in both areas was an issue <br /> brought up by the Design Review Committee and they will address it . Also <br /> P,ir.. Seaburg, the architect agrees to move the units back from the bank but <br /> doesn' t know how far -back. <br /> Mr . Fudala read from a report by the Bog Association which suggests a. 150' <br /> buffer between bogs and buildings . Att . Kirrane said the developer does <br /> own the bogs and does have control over how things are done . Mr. Seaburg <br /> said the buildings are now proposed loo' fro? the bog. rJr..
