Mr. Rowley said he would have to say that what 's sho-vm on the plan is relatively accurate , but the question is if M-r. Jonas has legal rights on what he claims to be a road and it 's not shown on the plan and they use the plan to convey the lot , Mr. Pomeroy said this is why we have land court to rake that decision, Mr. Dubin asked to what extent is it abandoned . Mr. Rowley said there 's no way you can drive i t . Mr. Jonas said it hasn 't been used for 40 years and V:tr ., Dubin said if that 's the case , it 's abandoned as it has to be a continuous use . The Board felt it was a legal question and up to 14r. Jonas to enforce his easement rights if possible , • Ifir. n► ler asked Y.1o. Pomeroy t show the drainage easements on the linen and change the slopes as he told them to do but they haven't ane . M-r .. Pomeroy will come to the December 19 meeting to have the plan signed, Mr , Dubin said the Board -will have to set up a special meeting to make decision on the Grogan special permit application. The Board agreed to meet at 7 :00 pm on December 19 prior to their regular meeting to do this . P, i_c ele Stone made a motion to approve the minutes from May to the present as they hadn't been approved before . Mr. Jonas seconded the motion and all voted in favor. Michele stone suggested the Board take5 or to minutes at the beginning • of th meetings to review the agenda and the minutes .
