Gessner said the Town Planner made t!;em rake the driveway easement . <br /> Torn Pi-lciala said he told them it was a. suggestion and he 's not an engineer. <br /> Mr. Ma kers said the Boar has the authority, and this is a completely <br /> new plan. They took out the recreation area., but they were supposed to <br /> leave the area in and designate it as recreation area , <br /> Mr. Dubin said they would take it under advisement and consult with Town <br /> Counsel and asked them to submit a written brief. He thinks they have <br /> a good argument that maybe a public hearing should be heard . <br /> Mr. nflarsters said they would need their permission to extend the vote <br /> 14 dans or they have to make a decision. Ir. Devaney objected to the <br /> road access ; he said he did 't zone the area and it shouldn't be resi- <br /> dential there . <br /> Mr. Dubin said the Board never thought much of the plan since therels n <br /> common space , no buffer- zone , no aesthetics , amenities , no safety measures <br /> added and takes everything the by-law allows . If they go into a subdivision <br /> the Board could persuade them to devote land to these considerations . <br /> Mr. Devaney said they're asking what they're entitled to by law. 'Mr. <br /> rViars teas said the law also maintains reason and logic and a reasonable <br /> person wouldn 't do this , He said it can still be dome right . They can <br /> prokc op the lots , and have a cul-de-sac without access to Rte . 151 . <br /> Mr , Devaney asked about the easement and. Mr. Marsters said it won't work <br /> as who will plow and maintain it . Mr. D-Nle said part of James Circle <br /> now being plowed and people living there . <br /> Michele Stone said the safety factor had been raised the night the plan <br /> was brought before the Board . r. Devaney said they can address that and. <br /> Ms . Stone said they haven't shown low. She said the access to Rte . 151 <br /> is the main problem if the road is berg brought up to standards ., <br /> Mr , Devaney presented another plan showing ars easement and not a. road <br /> and said it 's a suggestion and would eliminated all access to Rte . 151 . <br /> Mr. Marsters said. it 's a road and it 's subdivision. . Doyle said <br /> if the only way to remedy it is to make a subdivision, they don't want <br /> to rake a subdivision. <br /> Mr. Marsters said they could panhandle it , but Mr. Devaney said it '-s not <br /> ea-sr, Mr. Mar ters said it will eliminate some lots and you meed 20' <br /> driveways coring from the other road , <br /> Mr. Dubin asked thea to come back with a. better solution than this . He <br /> said he would consult with Town Counsel on the Bailey and Trlstor± Landing <br />
