He suggested bringing all parts of the deck within the 76 ft. contour. Ms Behr an suggested the 77 ft. contour be the work limit. Mr. Tavares agreed the top deck will be between the 77 and 76 ft. contour but at no time over that contour. Ms Behr an pointed out the old pad to be removed is not on the plan or in the Notice of Intent, nor removal of the old structure; it should be on the plan to remove an existing structure. Mr. Sherman asked if the structures which are towards the water from the base of the bank are permanent. Mr, Pel us i advised he is giving consideration to them being seasonal because of freezing. If the Commission has a preference he would address this. Ms Behrman requested soundingsand Mr. Tavares agreed. Mr, Sherman stated he Would not feel comfortable i thout some professional advice concerning the adverse effect of this project, Ms Behran agreed the size of the deck is a concern with wildlife. She questioned the usage of the dock. Mr. Peiusi stated it is to get the kids out to swim off of it and they have friends with a boat on the lake; they could put a boat there and not bring it to shore. Ms Behrman advised the immediate edge of the pond is a herring spawning area and should be avoided as far as the dock. Mrs* Simmons asked if Mr, Pelusi would be willing to get an opinion for Mr. Sherman's concerns? Mr. Sherman asked if they had a response from Natural Heritage re wildlife habitat? Mr. Hall stated they left that incomplete at this time as they were unsure whether ars Environmental Impact study was to be done. Mr. Sherman stated Appendix A has to be sent for the situation to be evaluated. Mrs. Simmons asked if they have applied to Board of Appeals and was told they Will apply. Mr. Coffey stated the size is imposing and tete presumption would have to be that it has an impact. Mr, Tavares asked, without input from that third panty, whether the size could be reduced to the satisfaction of the commission, the other issues notwithstanding. It was noted the upper platform is 10 X 15.
