CONSERVATION COMMISSION: PAGE I 8:50 PM: Hearing on application of Northworks Properties, Inc. to amend the Order of Conditions for S -1225 for completion of deck and landscaping per plan, at 95 popponesset Island Road, Assessors Map 112, Block 31. Bob Sherman explained that we had issued an amended order that stated that we denied the deck that he wanted. We said that we- would consider, I believe, a ten foot deck. He had to submit a revised plan. He has agreed to that. He has submitted a revised plan that conforms to that 10 foot deck that we said that e would consider. I think that we should reverify the plan and make: sure it i proffer and thea-: e should issue. Public Co en Bob Forte 2 representingD ane, abutter. They currently have a suit in Land Court for a right of gray ptbblem. Until this situation on the easement is cleared up, on the right of war problem that we have, I think anything that is done on that property right now may, or may not, affect the future outcome of this easement problem we have. So, as an abetter, I dope that I may be in aposition to object to the building of anything. Bob Sherman stated that he was in a position to object, but Bob could not see where this deck is in this area is being contested. Bob Sherman: My feeling is, Elliot can correct me If I not, if the project does not torch the' contested area, I don't think we can touch it. Elliot: There are two things here.
