Regarding the wildlife habitat issue, Bob met twice with Messrs. Schall and Grotzke to <br /> consider possibilities for enhancing vegetation. iVlr. schall has some interesting ideas <br /> which Bob won't rule out at this time because it's premature. He has advised them that <br /> if they come up with a finite plan for mitigation with vegetation enhancement, we mould <br /> probably invoke Section 12 of our by-laws and ask for a second opinion, which the <br /> applicant would have to pay for. It's a complex site, which everyone has <br /> acknowledged, and Bob doesn't feel comfortable making a judgment without having <br /> another opinion, <br /> .hack said because the proposed work on this property may be somewhat controversial <br /> to some of the neighbors, and it's obvious that we will have to continue because of the <br /> two major issues, we would prefer that no data be given this evening so we make sure <br /> that we wouldn't have a legal problem having to go forward with a continuance when <br /> the same members might not be present. Bob suggested that Mr. tarot ke leave the <br /> plan with the members. <br /> Mr. Grotke said that since he has two consultants present, he would like them to <br /> review the issues orally, and they would leave with the members reports which would <br /> summarize their discussion. <br /> Elliot said we have an opinion from Town Counsel that anybody who has not heard <br /> every bit of evidence in connection with a case cannot vote on it. Elliot's opinion in an <br /> issue as complex and controversial as this, is that it would not be advisable to either <br /> the applicant or the Commission to proceed tonight. We're doing to have to have <br /> second opinions, and we should have that data and the consultants' data at the same <br /> meeting to make a decision. i <br /> IVIS. Turano-Flores said they have submitted narratives that answer the chronology of <br /> the resource area delineation, a wildlife habitat evaluation and a vegetation landscape <br /> plan. Bob said the analysis has been forwarded to Jim O'Connell, former CZM <br /> geologist, now with the sea Grant Program} who has volunteered to review it. Mr. <br /> O'Connell called Bob today and he has some questions regarding the chronology, but <br /> they didn't have time to discuss it today, so he's meeting with him net Tuesday. <br /> In terms of the wildlife habitat analysis, Bob said that Mr. schall has done one and he <br /> respects his work. However, since it is just being submitted tonight, he hasn't seen it. <br /> He has already indicated to the applicant's representatives and to this Board that he <br /> recommends we submit those pians and narratives for a second opinion. <br /> -Ms. Turano-Flores asked when they can expect to receive the second opinions. Bob <br /> restated that Mr. schll's plan was just received tonight, and the people who will be <br /> giving the second opinions can't indicate when they will give these second opinions <br /> until Bob formally submits the data to therm. There's a procedure for that which he can <br /> discuss with Ms. Turano-Flores tomorrow. Bob will expedite it as much as possible, <br />
