Bob said it doesn't matter what was done in the past. The by-laws provision for <br /> setbacks supersedes any permits that were granted before this provision was enacted. <br /> He would like to have a continuance because he thinks there's a likelihood of an <br /> appeal here and he wants to make sure we're on legal ground in terms of the two <br /> sections of our by-laws that apply-. <br /> Ms. Turano-Flores submitted for the record evidence on three order of Conditions that <br /> were issued since Regulation 29. Jack said each case is handled on its own merit. <br /> Robert spencer, 7 ocean Bluff Drive, said a mitigation pian dated the 26th was <br /> mentioned in this hearing, and none of the abutters have seen that. Bob said that's <br /> another reason to continue this hearing. lir. spencer requested a copy of lir, schall's <br /> wildlife habitat plan. lir. Grotze will provide it. <br /> Motion made, seconded and unanimously approved to grant a continuance to ( larch <br /> 13th at T20 p.m., at the request of the applicant. <br /> 7:20 .rte., Harold Butler, 87 James circle (continued from 2/6/03). Bob recommended <br /> approval. <br /> Motion made, seconded and unanimousl carved to approve the plan, <br /> 7:25 .m., Michael Int c ial, 134 Hopponesset Island Road {float alteration, piles} tree <br /> removal, pool, cabana, wall construction: regrading, new stairway, fencing and <br /> landscaping). Mr. Intoccia was resent and ,John slavinsk Cape & Islands <br /> p a h <br /> Engineering, and Arlene Wilson, A. M. Wilson Associates, presented the plan. <br /> Ms. Wilson said they have withdrawn their request for modification of the pier and float <br /> for now. she said tonight they would like to discuss the walkway between the upland <br /> and the pier, the pool, the landscaping and the fill in the driveway. <br /> Bob said he has reviewed the plan, and he would have to recommend a denial as <br /> presented because it doesn't come close to our formula for mitigation in these <br /> circumstances. He recommended a continuance to allover further discussions with Mr. <br /> Slavinsky and Ms. Wilson. <br /> Motion made, seconded and unanimously approved to grant a continuance to March <br /> 13th at 7:25 p.m. <br /> 7:30p.m., Bay Point Realty l `gust,, one Point Road, (construct garage, pave driveway, <br /> parking and travel war location). John slavinsky: cape & Islands Engineering} and <br /> Eric Benwa , sound Realty, represented the applicant and presented the plan. Bob <br />' <br /> recommended approval. <br />
