Tom9n of Maslipee. <br /> ' I6 C" rat eck-lItpad 'brth <br /> Al } � )ashp( s1fussw <br /> -. <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> VARIANCE-2017-18 <br /> Southworth Cape Development, LLC Title Reference Book: 26395 <br /> 130 Willowbend Drive Page: 271 <br /> For Property at: 61 Pleasant Park Drive <br /> (Map 70 Parcel 162) <br /> Mashpec, MA 02649 <br /> A Petition was filed on March 10, 2017 by Southworth Cape Development, LLC, <br /> requesting a Variance under§174-31 (Land Space Requirements) of the Zoning Bylaws to <br /> deem lot buildable on property located in an R-3 Zoning District, 61 Pleasant Park Drive, <br /> (Map 70 Parcel 162), Mashpec, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpce Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 17, 2017 and March 24, 2017 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, and Scott Goldstein, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Attorney Kevin Kirrane represented the application for the variance request. Mr. <br /> Kirrane provided a copy of the subdivision plot plan that was approved in 1984. The zoning <br /> criteria was 20,000 sq. ft., and since then zoning criteria has changed to 40,000 sq. ft. Back <br /> in 2013 the Zoning Board granted this variance for this particular lot, and at that time <br /> Southworth Development thought they had a buyer that was prepared to purchase but it did <br /> not happen. They apparently have a buyer now who is interested in buying the lot and is <br /> seeking the same variance. Since that variance has been in place all the lots on either side <br /> are separately owned, and were separately owned at the time the variance was granted in <br /> 2013. <br /> Mr. Goldstein read the Conservation, Board of Health and Inspection Department <br /> continents into the record. <br /> There were no abutters present. <br /> 1 <br />
