Board of Appeals Minutes - October 23, 1991 12 . <br /> M . Makunas : Yes, but this is not the forum . This is what <br /> we are supposed to address --- things that are <br /> in here . That has to be addressed, there is <br /> no question about it . Why read something in <br /> here that ' s not in here . <br /> S . ferry; May I make a comment? <br /> W. Hanrahan : Go ahead . <br /> S . ferry : Why, if you feel you can, make the decision <br /> tonight, why not make the decision because, if <br /> you don ' t, there are a number of people in <br /> this room that are going to call the Building <br /> Inspector and go down there tomorrow and start <br /> enforcement procedures on the three sides . If <br /> you can handle it tonight, why put it off? <br /> W . Hanrahan : Because, again, the forum is that we ' ve been <br /> petitioned to hear what ' s been brought up in <br /> this letter and we don ' t have the power to do <br /> anything else . <br /> S . Perry : But the facade . . . . <br /> W . Hanrahan : I hear what you ' re saying and I ' m not a <br /> lawyer. That could be a question for Town <br /> Counsel . Can we broach that subject? If it ' s <br /> not in the Building Inspector ' s decision <br /> that ' s before us and the cause of this thing . <br /> I don ' t know . I don ' t think we can . If you <br /> find out there is a subsequent violation and <br /> it is appealed then we might be the forum for <br /> it . It is a question of legal standing . That <br /> is not to say that there is or there isn ' t a <br /> violation . I am not discussing the merits of <br /> the violation per se . As Chair, I ' m open to <br /> suggestions . <br /> Mrs . Burtis : I ' m Mrs . Burtis and I suggest that we do not <br /> appear before the Board next Wednesday because <br /> we have a commitment -- a social commitment in <br /> the Town of Falmouth and the Falmouth Chamber <br /> of Commerce . Would that be O. K. <br /> M . Makunas : I don ' t think we ' re talking about appearing <br /> before this Board . It ' s the Design Review . <br /> We ' ll have to make other arrangements . I <br /> think he ' s scheduling a special meeting . <br /> W . Hanrahan : Board of Appeals meets the second and fourth <br /> Wednesday . The Board of Appeals can make a <br /> time stipulation for getting this thing <br /> resolved by Design Review. What do you <br /> suggest -- 21 days? That sounds reasonable . <br /> G . Driscoll : If you do grant Mr . Burtis an extension <br /> ultimately what will happen in terms of <br /> penalties if he doesn ' t perform for what you <br /> stipulated? <br /> W. Hanrahan : I ' ll let the Building Inspector answer that . <br /> If the extension is granted by the Board and <br /> he doesn ' t comply within the parameters of <br /> that decision, what are the penalties? <br />
