Board of Appeals Minutes - October 23, 1991 13 . <br /> D. Boyd ; We would have to go to court and seek <br /> injunctive relief . <br /> W . Hanrahan : The Town would go to court -- the Town being <br /> the Building Department as the zoning <br /> enforcement . <br /> M. Makunas : I don ' t believe you can come here again on the <br /> same issue . <br /> J . Mills : I suggest that if the Board is inclined to <br /> grant an extension that granting would be <br /> contingent on the posting of that bond . <br /> D. Boyd : I think the bond should be in place long <br /> before the 90 days . <br /> W. Hanrahan : It should have been in place all along . <br /> K. Perry : I would like to ask Design Review if your <br /> plans have to be stamped by an engineer? <br /> M . Makunas : It ' s not a requirement . <br /> W . Hanrahan : Those specific plans can be dated . . . the <br /> Design Review Board is advisory to the Board <br /> of Appeals and the Planning Board . The two <br /> policy-making Boards can accept or reject <br /> their advice . <br /> M. Makunas : There is a landscape architect and an <br /> architect who sit on the Board, a <br /> representative of the Board of Appeals, which <br /> is myself, and the Building Inspector sits on <br /> the Board . That makes up the Design Review <br /> and it is advisory -- it is just to look at <br /> things and hash out before it gets to . . . . <br /> K. Perry : If you ' re just an advisory board actually you <br /> have no power. <br /> M . Makunas : That ' s right . <br /> D. Boyd : It has worked very well . . . . <br /> W. Hanrahan : As a general rule the two Boards follow their <br /> recommendations . <br /> M . Makunas : We are usually pretty tough and things get <br /> changed quite a bit before they get to the <br /> Boards that they end up at . I have a <br /> suggestion that we take this under advisement <br /> and expect that #7 and #8 would be resolved <br /> within 14 days then the granting of the full <br /> 90-day extension for item #2 . That ' s my <br /> suggestion . It is not a motion, just a <br /> suggestion . <br /> W . Hanrahan : Any comments? <br /> M. Makunas : I ' ll put it in the form of a motion if there <br /> are no comments . <br /> C. Hawver: I think 14 days is more than generous -- more <br /> than generous . <br /> M . Makunas : Does that sound reasonable? I ' ll put that in <br /> the form of a motion . <br /> W. Hanrahan : That dovetail ' s with the meeting of the Cape <br /> Cod Commission . <br />
