Board of Appeals Minutes - October 23, 1991 14 .
r
C . Hawver : Do you want anything sent to the Commission?
M . Makunas : After 14 days . I think the 14 days is the key
time frame . In other words, if things fall
into place then the 90 days should be fairly
automatic and then the Cape Cod Commission
could be notified of our official 90--day
extension .
W. Hanrahan : We said 14 days from tonight?
M . Makunas : Let ' s make it easy on the petitioner . Let ' s
not . —
W.
ot . —W. Hanrahan : By November 6?
M . Makunas : Let ' s find out from the petitioner whether he
can meet that date .
W. Burtis : November 6?
M. Makunas : Are we meeting that night?
W . Hanrahan : No .
M . Makunas : O.K . Design Review will meet that night and
hopefully resolve that and the following week
the. Board of Appeals will have all the
information before us and put it on the agenda
for that night and the 90 days can be
officially extended that night if everything
else falls in .
V . Driscoll : When does the 90-days start? Tonight or as of
October 4 when he was supposed to have the
work done under the original 120 days?
M. Makunas : I think it starts . . . .
E . Walsh : Could I have a motion?
M . Makunas : My motion was that we take it under advisement
pending the solution of items #7 and #8 within
14 days and, if those two items are resolved,
that we vote favorably for a 90-day extension .
C. Hawver: I ' ll second that .
W . Hanrahan : All those in favor .
All : Aye .
E . Walsh : Would you be taking the final vote on the 13th
or just the way it is here?
M . Makunas : No . At the next meeting night we will get all
the information from Design Review and we will
have on the table what the results are of the
14 days . At that time we can decide .
W. Hanrahan : 90 days from tonight is January 21st .
D. Boyd : May I also suggest that we ask Town Counsel
for an opinion?
M. Makunas : On which items -- on the three sides?
D. Boyd : Yes .
M. Makunas : Why can ' t the Building Dept . ask for an
opinion on that since it is a building
dilemma?
D. Boyd : All right . . . . it is a zoning . . . I ' ll ask .
is M . Makunas : It ' s a dilemma of issuing a building permit
for a structure with two sides .
