Board of Appeals Minutes - October 23, 1991 16 .
r
V . Driscoll ; Yes, we have .
M . Makunas : You ' re not the petitioner -- you haven ' t been
the petitioner.
V . Driscoll : We have been before this Board seeking relief .
Not tonight but in the past we have .
M . Makunas ; People who petition us -- they are the ones
seeking something --- a Special Permit or
relief in this case . You have never been
before this Board seeking relief . You ' ve gone
to Superior Court but you haven ' t been to this
Board .
V . Driscoll : So you mean I could come now to this Board?
M . Makunas : I think you had better talk to your attorney
because it gets kind of complicated . This is
definitely a process and these other people
have . . . .
J . Mills ; I hate to get .into this but these abutters
have a right and standing in this forum and I
don ' t think that should be belittled .
M . Makunas : How is it belittled?
J . Mills : Saying that they aren ' t coming to you for
relief .
M . Makunas : They haven ' t . The term "relief" is used in
reference to a petitioner who fills out a
form,. applies . . . .
J . Mills : If the relief was only for the petitioner
there would not be the necessity of notifying
abutters . In other words, all parties are
concerned and I don ' t think you should beat up
on them .
W. Hanrahan : That ' s not what he said . He said that they
did not petition the Board of Appeals . The
petitioner petitioned the Board of Appeals .
In this case it is statutorily proscribed .
M . Makunas : You know the process Judy, and you ' re just
turning it around for whatever reason .
J . Mills : No, I ' m not . I ' m saying abutters have a
standing in this forum .
M . Makunas : They definitely have a standing but not as
petitioners .
J . Mills : I don ' t think they call themselves
petitioners .
M . Makunas : That ' s what I was explaining to them.
K. Perry: How can we become petitioners? If that ' s what
you want, we ' ll become petitioners .
M . Makunas : I think you should see your attorney or see
Judy -- she will explain .
K . Perry : I don ' t think that was called for.
R . Bevacqua : I think you ' re missing a point .
W. Hanrahan : Name?
R . Bevacqua : I 'm Ron Bevacqua . He ' s petitioning for relief
from you .
W. Hanrahan ; No, he is not . He ' s petitioning for relief
from the Building Inspector.
