10 Board of Selectmen Minutes March 11, 2002 APPOINTMENTS AND HEARINGS: Sealer of Weights& Measures: Ray Bowman, Sealer of Weights&Measures was present to propose fee increases, additions and the official job description of such in accordance with the Consumer&Merchant Protection Act of 1998. Mr. Bowman indicated that most of the fee increases as proposed are due to mandated changes in testing and inspection procedures that would protect consumers and insure that equity would prevail in the marketplace. A major component of the Act requires a bi-annual inspection of scanners in stores that have three or more scanners. An annual inspection fee has been included in the Act. .Recording keeping is also a primary concern for all weights and measures. The fee structures as proposed are similar to that of neighboring Upper Cape towns. It was noted that the Building Department assumes budgetary responsibilities for the Sealer, and all fees collected are generated back to the Town. Motion made by Selectman Marsters to approve the Fee Increases/Additions and new Job Description of the Sealer of Weights and Measures as reflected in the memorandum of November 26,2001. Motion seconded by Selectman Leveille. VOTE: Unanimous. 5-0. Bike Zone—BMX Racine: Kenneth Alty of the Bike Zone of Falmouth waspresent to request the Selectmen consider donating land for the installation of a BMX racing track. It was noted that approximately 5-10 acres is required for the track and parking facility. The Selectmen discussed the request to bring a BMX racing track to the Town of Mashpee. Issues requiring further clarification include the review of the Cape Cod Commission, zoning, and parking. The Selectmen requested the applicant discuss the feasibility with Town Planner and DPW Director. The matter was taken under advisement at this time. •
