10 <br /> Board of Selectmen <br /> Minutes <br /> March 11, 2002 <br /> APPOINTMENTS AND HEARINGS: <br /> Sealer of Weights& Measures: <br /> Ray Bowman, Sealer of Weights&Measures was present to propose fee <br /> increases, additions and the official job description of such in accordance <br /> with the Consumer&Merchant Protection Act of 1998. <br /> Mr. Bowman indicated that most of the fee increases as proposed are due <br /> to mandated changes in testing and inspection procedures that would <br /> protect consumers and insure that equity would prevail in the marketplace. <br /> A major component of the Act requires a bi-annual inspection of scanners <br /> in stores that have three or more scanners. An annual inspection fee has <br /> been included in the Act. .Recording keeping is also a primary concern for <br /> all weights and measures. <br /> The fee structures as proposed are similar to that of neighboring Upper <br /> Cape towns. It was noted that the Building Department assumes <br /> budgetary responsibilities for the Sealer, and all fees collected are <br /> generated back to the Town. <br /> Motion made by Selectman Marsters to approve the Fee <br /> Increases/Additions and new Job Description of the Sealer of Weights <br /> and Measures as reflected in the memorandum of November 26,2001. <br /> Motion seconded by Selectman Leveille. <br /> VOTE: Unanimous. 5-0. <br /> Bike Zone—BMX Racine: <br /> Kenneth Alty of the Bike Zone of Falmouth waspresent to request the <br /> Selectmen consider donating land for the installation of a BMX racing <br /> track. It was noted that approximately 5-10 acres is required for the track <br /> and parking facility. <br /> The Selectmen discussed the request to bring a BMX racing track to the <br /> Town of Mashpee. Issues requiring further clarification include the <br /> review of the Cape Cod Commission, zoning, and parking. The Selectmen <br /> requested the applicant discuss the feasibility with Town Planner and <br /> DPW Director. The matter was taken under advisement at this time. <br /> • <br />
