July 17 , 1980 <br /> Board of Selectmen <br /> Town of Mashpee <br /> Main Street - Box 1108 <br /> Mashpee, Massachusetts 02649 <br /> Re : Modification of rules governing sale of alcoholic beverages <br /> Dear George : <br /> I am enclosing herein a suggested format to be used by the <br /> Board in addressing the issues raised by the ABCC in the Crea- <br /> tive Restaurant d/b/a The Farm decision, the same being the sub- <br /> ject matter of the meeting yesterday with the various license <br /> holders . <br /> • At the meeting yesterday, an indirect reference was made to <br /> sale of alcohol on Sundays at 11 : 00 A.M. I was troubled by the com- <br /> ments that were being exchanged by the parties in attendance and I <br /> surveyed the law controlling Sunday sales and I would like to point <br /> out the following information. <br /> Chapter 138 , Section 33 of the General Laws prohibits the sale <br /> of alcoholic beverages before 12 : 00 noon on Sundays . Section 33A <br /> authorizes a Town to adopt its provisions and thereby enable the <br /> Selectmen to permit the sale of alcohol on Sunday between the hours <br /> of 1 : 00 A.M. and 2 : 00 A.M. Itis important to note!�that this may <br /> only be done if the Town votes to accept the provisions of Section <br /> 33A. Section 33B is another adoptive statute which provides that <br /> the Board may permit the sale of alcoholic beverages on Sundays be- <br /> tween the hours of 11 : 00 A.M. and 12 : 00 noon IF the Town so chooses <br /> to give the power to the Board. <br /> I do not know if the Town Meeting has voted to accept the pro- <br /> visions of Chapter 138 Section 33A and/or Section 33B . It is impera- <br /> tive that this be ascertained. If the Town has not voted to accept <br /> either one of these sections , it may be that vaLrious license holders <br /> in Town are inadvertently violating t aw. <br /> You s v t y, <br /> • n <br /> r;m <br />
