Murphy . <br /> CUESTS : Attorney Marcel Kistin, Mr. Allen Elloian from Ellco Construction <br /> and Ms . Jane Peterson. <br /> 2 : 00 p.m.- - Convene Meeting.. <br /> Motion by Sel . Garland to accept the minutes of the December 7 , 1982 <br /> Administrative and December 8 , 1982 Regular meetings . Seconded by <br /> Chm. Thomas . This is a vote . <br /> 2 : 00 P.M. - Attorney Kistin presented the Board with a Deed for Conservation <br /> land, recorded with the Barnstable County Registry of Deeds , in Plan <br /> Book 216 , Page 23 , this parcel contains 45 , 141 square feet.. He <br /> did not like the wording on page five of the deed. He asked the <br /> Selectmen to accept the deed and he would have that page retyped. <br /> Board accepted the deed. Board thanked Attorney Kistin. <br /> 2 : 30 p .m. - Mr. Allen Elloian came to speak to the Board. He stated as <br /> follows . <br /> Mr. Elloian: "I don ' t know if there is a misunderstanding or lack of <br /> communication between the Boards or the paper or whatever. <br /> The statement here that we weren ' t there , now the only <br /> • obligation I have to you is according to the contract is <br /> to work forty hours a week, I do the work you pay for the <br /> work . We ' ve worked more than eight hours a day . There was <br /> three days that we weren' t there . Three days which it rained. <br /> One of the rainy days we weren' t there , one day we weren' t there <br /> entirely and one day we got locked out , and I refused to <br /> work in case someone got hurt we had no way of getting out. <br /> Days that it didn ' t rain we worked two Saturdays and one <br /> Sunday . You people are under the impression that it took to <br /> long to do the job we did, I feel as though we didn ' t . I <br /> think I am more capable than you people to decide that and <br /> if I am not your engineer is . Your engineer' s report stated <br /> that we were going in a workmen type manner, and that there <br /> was some days that he didn' t think that the work was getting <br /> done as fast as he stated, but. in two days it got progressively <br /> fast . It is awful difficult for a man to come in for five <br /> minutes or ten minutes a day and decide whether we are going <br /> fast enough or not going fast enough. If there was somebody <br /> standing with us eight hours a day , I could understand . That <br /> wasn ' t the case . Another case was I gave a price on it , twice <br /> I held it at $16 , 400 . The first time you people put it in the <br /> paper, I don ' t know who it was , but that was .not to be put out <br /> in the paper. I still stuck with that price . The third time <br /> I couldn' t. The $19 , 400 . instead of the $16 ,400 . We broke <br /> • even on the thing. If I wanted to at any time , because of the <br /> way the contract read, I could of stopped working because I <br /> encounted clay , I ,didn' t have to go any farther than that <br /> since it was suppose to be operable since it was built. It <br /> wasn ' t those things failed the day that they were put in. <br /> There was clay down there , and no one was monitoring the last <br />
