Right now <br /> there is an agreement between this Board and the Board of Health. <br /> They have absolute control on what goes on down there . So in the <br /> future any comments they will be totally responsible for it . <br /> At that time you were caught between an engineer and two Boards <br /> and none of them really knew what was going on. I was down <br /> there personally and there was no one in the place. Statement <br /> in here that your people left at 10 : 30 a.m. for coffee 'and never <br /> came back again. I don ' t know if that is true or isn' t true. <br /> That was the statement made . : <br /> Mr. Ellioan; There was one day that you and Mrs . Anderson came down there <br /> you people couldn' t find me, my pickup truck was there , we <br /> were down the hole digging. " <br /> Sel. Garland: The point was , there was a number of alligations made there <br /> was no one institution or department responsible for the job . <br /> Now there is , so if you feel that you have been maligned , as <br /> I feel that you do, than I feel I would have to offer you my <br /> personal apology. I am not sure that everything is black and <br /> white in this situation. I think that when the contract was <br /> left , I think that when the contract was handle originally, <br /> was probably not handle the best way possible , I think the <br /> contract should have included some items such as a penalty <br /> clause upon completion for the protectionof the Town. Also <br /> should of provided for a clause for the contractor in case <br /> they ran into a condition other than the specifications . I <br /> would like to try .to convey to you as far as I am concern the <br /> Board of Health has the sole total responsibility for the opera- <br /> tions of that dump. In the future if anything defects down <br /> there, they are the ones responsible for coming up with the <br /> answers . " It could have been used December 1 , it could of been <br /> used prior to December 1st. <br /> Sel.
