Ed stated that regarding putting that much control in the hands of the clerk, <br /> he stated that they are, according to the contract and the laws, the interpreter of the <br /> drawings and if the city wants to put that responsibility in the hands of the clerk} he thinks it <br /> is an enormous mistake and it confuses all sorts of liability. Paul agreed and stated that if <br /> SMMA is going to have the legal responsibility for that, then they should leave it in their <br /> hands and not allow anyone else to have any opportunity for a different interpretation. Tony <br /> stated that they had tried that at the Federal Courthouse in New Hampshire, and stated that <br /> the problem is then you have two methods of providing information and can get into such <br /> detail if you explode or enlarge a detail and if it doesn't correspond to ghat was drawn on a <br /> paper, thea you are left with two issues that are different which results in claim problems in <br /> charge of condition that cannot be allowed. Steve stated he realized the ramifications and <br /> cited an example of his experience. Steve also asked if there was a mechanism for feeding <br /> the as-built drawings back into the final CAD disks that will be provided. Paul stated that he <br /> understood that at the end of the project, SMMA would give therm a set of as-built drawings <br /> completed on paper and at our request one set of DF files on disk. Phil stated that they <br /> were not responsible for as-builts. Ed suggested that they go luck and make sure that Joe <br /> answers this issue. Tony said that there was only one area where a contractor at this stage <br /> and technology would want the electronic information is when he did coordination for the <br /> drawing for the ductwork or mechanical on a CACI for shop drawings. <br /> D Estimate: Merry sue asked if anyone knew how many were going out. Fd stated that <br /> about 25 to 30 from their office. Steve commented that all of the budget figures were in <br /> press and that was not the particular advantage that they want. He stated that they are all a <br /> matter of public record. Torn Wren distributed a copy of the CD Estimate to all members <br /> and explained each of the columns beginning with the first being MA's CD estimate as of <br /> 2/14/95. The next column was the approved savings which had been collated and <br /> dispensed amongst the line items. The third column is the first column minus the second. <br /> The fourth column is the list of alternates which was issued since the school committee <br /> meeting on the 3/2/95 and he stated that they have made an attempt, especially with the <br /> alternate for the auxiliary Byrn to spread these through the various trade items. The last <br /> column is a subtraction of the alternates from that last column. He stated they have a figure <br /> at the end of'ust under $20 000,coo. Paul asked if they were expecting the $20,000,000 to <br /> come in, but does not include the overhead and profit and the jab conditions. Tem stated <br /> he did not have the answer to that but that maybe SMMA might have the answer on that. <br /> There were two of the alternates that were not included as items in the 214195 CD estimate, <br /> he said that was 5, the irrigation well and , the site irrigation. He stated that also that <br /> the Early Site Package, which has been confirmed with SMMA, that the estimate of this is <br /> about $300,000 but he left the figure stand at $63,150 because that was what actually <br /> appeared in the 2/14/95 estimate. Paul asked Tom if he was also working up the overall <br /> budget. Torte said yes, he did not have a sheet to pass around but the bottom line figure of <br /> $28.7 million remains the same as what was previously passed around* He received the fax <br /> which Paul seat hire but he has to regroup those. Paul agreed to gait until they got the <br /> regrouping of the new estimate so that they can issue one piece of document. Paul stated <br /> that he asked Torn to take the original budget in column one that we had agreed to. <br /> Second: to come up with where they were to date as of 3/14/95. He stated that this is <br /> where the moneys are that we believe that we are going to be at. Basically, the CCS is still <br /> just an estimate, but including in that is the FF&E which is now, until we get better <br /> information, is at $4.1 million and then what do we see the projedt being at that time, He <br /> said that right away, that at 4.1, they know the number is going to be over $28 million. He <br /> said at least they will know how much they will owe based on that FF&E and it will tell us <br /> ghat we need to shoot for to get it down. Steve commented on the Early Site Package and <br /> asked haw it ballooned from $63,150 to $300,000. Phil stated the number that was included <br />
