4 <br /> MASHPEE HIGH SCHOOL BUILDING COMMITTEE <br /> Tuesday, March 14, 1995 <br /> Page 13 <br /> in the Daedalus report was holdout prior to the drawings being completed so that was just a <br /> verbal phone discussion between Daedalus and Brian. He stated Daedalus has included in <br /> the overall estimate the cost of all of the site clearing but the portion of it that was pulled out <br /> was a miscommunication because that was written before the documents were done. The <br /> $300,000 is SMMA's estimate of the Early Site Package and the Early Site Package and the <br /> final drawings have been forwarded on to Daedalus and they are in the process of reviewing <br /> and confirming. Merry sue asked if some of the Early Site Work money up in the column is <br /> actually a part of that $300,000. Ed agreed and stated that they did not take enough out of <br /> the base bid and put it into the advanced package in our first telephone discussion. Steve <br /> stated that $300,000 had to be more than clearing and grubbing. Phil said that it was also <br /> silk fence and drainage and erosion control, etc. Paul stated that there is some piping in <br /> there as well. Phil stated that because you are clearing, you have to do mediation <br /> measures whether you are implementing immediately or not. <br /> Early Site Package Update: Paul stated that the Early site Package went out to bid and <br /> asked where they stood on that issue. Phil stated they were due on the 23rd of March. <br /> Toni asked if there was going to be a pre-bid conference tomorrow morning. Paul stated <br /> that was for the first package. Ed stated that a couple of months ago they had no way of <br /> knowing that the Department of Education's approval process was going to overlap with <br /> MEPA's approval process and now it is clear that they are overlapping. All of their <br /> discussions with MEPA indicated that this was not a problem. Their discussions with Jiro <br /> Andersen, who Ed spoke with that day, indicates that it is a problem. He said he couldn't <br /> sign off until all of the documents are in and we are in the process of getting all of the <br /> documents in. Jim's interpretation of the site package is that it is part of the project and that <br /> he cannot give signoff on that until MEPA approves it. MEPA disagrees. Ed explained that <br /> they find themselves in between the two organizations trying to resolve It. Ed's last <br /> conversation with Jima that day, was that he absolutely will not approve it. He has gotten an <br /> interpretation from council. Ed told hire that after he reported this, he would be receiving a <br /> lot of phone calls and couldn't they resolve it. Brian got on the phone with MEPA who <br /> brought it all the way up to the Director and, their interpretation is that if they approve the <br /> project subject to M E PA's approval, if they word it that way, they meet all the intents and <br /> purposes of all of the regulations, per the Director of MEPA. They also agreed to be in <br /> contact with Jim to resolve this and that they agree to it one way and he agrees to it another <br /> way. Paul asked if this was something they should get Tarry Cahear, the State Rep, <br /> involved in. Ed stated not yet because he can most effect MEPA and MEPA is already on <br /> our side. Paul asked if he couldn't tally to the educational group. Ed stated that it was a <br /> little tougher because they are not as directly responsible to him but he said it was a <br /> possibility. Steve asked where they should in terms of after the fact approval. Ed stated <br /> that according to Jiro, potentially we could lose their reimbursement on that site package. <br /> Maul asked even though we are going to comply. Ed stated that Jim cannot approve the <br /> project until he receives all of the paperwork. Jim's interpretation of getting all of the <br /> paperwork in is getting CJI EPA's approval. Paul said suppose it is May 1st and he says you <br /> have approval and thea we walk in on May 2nd and say we are done with phase 1. Paul <br /> stated it was a technicality. Ed told Jing that this was really not an issue of substance, this <br /> was a technicality, but Ed suggests that we all wait until MEPA either writes or talks to Jim <br /> to give hire their interpretation. Phil stated that it was being submitted tomorrow and the <br /> next notice in the Monitor is on the 22nd. The 30 day approval process is complete on <br /> 4124/95 and thea the secretary has up to 7 days to issue a written statement, which is May <br /> 1st. Paul stated thea that is when we could start the second phase but we have agreement <br /> from MEPA to do the first phase. Ed stated that the Committee is risking the <br /> reimbursement, which is $180,000. Phil stated that they had been through the entire <br /> process, the draft to E I R, the comments to the draft to E I I , the final E I P which responds to <br />
