Board of Selectmen <br /> f <br /> Minutes <br /> May 10, 201 <br /> APPOINTMENTS AND HEARINGS <br /> Board ofL a Trustees: <br /> Bo <br /> Jane Dolan and several members of the Library Board of Trustees was in <br /> attendance with Helene IeFoe the Library Director to discuss the lack of <br /> appropriate staffing at the new Mashpee Public Library. As a result, the <br /> Library Board of Trustees issued a Position Statement to the Selectmen <br /> dated May 5, 2010 outlining their daily tribulations. <br /> It was noted the Friends of the Mashpee Public Library gifted funds to <br /> support the solar photovoltaic proj.ect and has requested that remaining <br /> funds be used to support additional staff independent contract labor. <br /> Correspondence was received from Town Counsel dated February 9, 2010 <br /> with respect to this regard. It is the opinion of Town Counsel that if the <br /> pose for which funds were donated has been fulfilled or becomes <br /> impossible to fulfill,the excess remaining funds could conceivably be <br /> returned by the same process required by statute for acceptance of the <br /> funds. Given the Town's lack of control over gift funds and the limited <br /> availability of said maids, it is imprudent, in Torn Counsel's opinion, to <br /> expend gift funds on departmental services. <br /> Joyce Mason, the Town Manager also indicated the $75,000 in funds <br /> donated from the Friends of the Mashpee Public Library has been <br /> expended for the purpose of which it was deposited. The money has been <br /> expended for its original pose,the photovoltaic project at the new <br /> Mashpee Library. And, in Town Counsel's opinion, to expend gift funds <br /> on departmental services would create a liability for the Town of <br /> Mashpee. <br /> Discussion followed.
