MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 22, 2018 <br /> Ms. Sangeleer read §174.25 I(9)Fixed and floating piers,wharves,docks,and boardwalks <br /> into the record. Mr. Bonvie made a motion to sponsor and amend §174-25 I(9) by deleting <br /> the paragraph in its entirety. Mr. Gould seconded yes. All were in favor to delete §174-25 <br /> I (9) in its entirety. <br /> -§174-17 Continuance; Extensions; Alterations. <br /> Mr. Mendoza explained to the Board that a lot of communities grant the Building Official <br /> the ability to issue a permit on structures that meet the zoning setbacks when the main <br /> structure does not comply with zoning. Example; if a house is supposed to have 40 ft. <br /> setback and the application is only 30 ft. setback, but a proposed deck meets all the <br /> setbacks, currently the applicant has to meet with the Zoning Board. In other communities, <br /> the Building Official can grant a permit because the application is not becoming more non- <br /> conforming. <br /> -§174-17 Continuance; Extensions; Alterations. Mr. Bonvie made a motion to sponsor the <br /> deletion in its entirety of§174-17. Mr. Gould seconded yes. All were in favor to delete in <br /> its entirety. <br /> Ms. Sangelcer read §174-17.1 Raze and Replace into the record. <br /> The Board revised the first sentence of the bylaw and amended the wording to read <br /> "dwelling structures". The Board also revised the second sentence to read; "any changes, <br /> extensions, alterations or reconstructions". <br /> Mr. Bonvie made a motion that the Zoning Board of Appeals sponsors a new section to <br /> 174-17.1 bylaw and the amendments read into the record. The additions are after the word <br /> "dwelling to add structures". Also the Zoning Board of Appeals finds that any changes, <br /> extension, alterations, or reconstructions of the pre-existing non-conformities..." <br /> Mr. Gould seconded yes. All were in favor of the revised wording and amendments to the <br /> bylaw §174-17.1. <br /> Mr. Pittsley made a motion to adjourn. Mr: Gould seconded yes.
