The Chair announced that she would need to open the next Public Hearing to be continued at a later <br /> time. The appointed time having arrived, Chairman Waygan asked for a motion to continue the <br /> Ockway Highlands Public Hearing. <br /> MOTION: Mar. Balzarini made a motion to continue the Ockway Highlands Subdivision <br /> discussion to 7:45 p.m. Mr. Kooharian seconded the motion. All voted unanimously. <br /> Returning to discussion about Article 14,the Chair recognized Joan Muse, 19 Captains Row, who <br /> stated that, as a real estate broker, she had no cell service when traveling and working in the southern <br /> portions of Mashpee. Ms. Muse stated that cell service was necessary for safety issues and <br /> accessibility. <br /> Carl Obelzik, 55 Tracy Lane, stated that he had attended a prior meeting at the library and suggested <br /> that the maps provided by the company showed that, with the location of the proposed cell tower, <br /> South Mashpee and the coastline would still not receive a cell signal, and suggested relocating the cell <br /> tower to New Seabury or Popponesset. <br /> Mr. Lehrer asked to make a point of order and the Chair responded that she was going to let the public <br /> speak. <br /> Michael Ronhock, 104 DeGrasse Road, stated that his phone worked in New Seabury, adding that <br /> texting would always be accessible. Mr. Ronhock asked who authored Article 14 and the Chair <br /> responded that it was her understanding that it was the former Town Planner, Mr. Fudala, who <br /> authored the Article. Mr. Fudala stated that he had drafted the Article because the Board of Selectmen, <br /> had leased the property to the company involved in the permitting process. It had been Mr. Fudala's <br /> opinion that the site was not in the Overlay District and a tower of that height would not be allowed <br /> without a zoning change. Mr. Ronhock stated his opinion that the proposed Zoning Amendment <br /> would create spot zoning in a residential area, for commercial purposes, at the whim of the Board of <br /> Selectmen. The current wording indicated that the parcel was not in the Overlay District and the <br /> proposed change would serve as a band aid, filed at the last minute. Chairman Waygan stated that it <br /> was considered by the Board of Selectmen on September 11 but noted that it was not included on the <br /> August 28 draft Warrant, Mr. Lehrer confirmed that the Board of Selectmen executed the proposed <br /> Amendment on September 11. Mr. Balzarini inquired when the project was sent to the Cape Cod <br /> Commission and Mr. Lehrer responded that it was sent in May. Mr. Ronhock noted that it was sent to <br /> the Cape Cod Commission with the opinion of Mr. Lehrer that the parcel was located within the <br /> Overlay. Chairman Waygan suggested contacting the Town Manager's office for the specific date. <br /> Mr. Ronhock inquired whether there was any consultation with the Planning Board and the Chair <br /> responded that they had received a copy of Mr. Fudala's proposed Amendment and she inquired about <br /> it at the August 271h Selectmen's meeting where the Town Manager advised that it would be reviewed <br /> by Town Counsel. Mr. Ronhock suggested that it had not been open to public comment with the <br /> Board of Selectmen. The Chair recommended reviewing the meeting video, Mr. Ronhock inquired <br /> whether the Board of Selectmen could submit Zoning changes and the Chair responded that Chapter <br /> 40A allowed for certain parties to submit changes to Zoning, including the Board of Selectmen. Mr. <br /> Ronhock inquired about what was outdated, as listed in the explanation and Mr. Lehrer responded that <br /> he believed it was related to the location of the Groundwater Protection District.
