particular project, and was awaiting a response from the Cape Cod Commission. Mr. Lehrer stated <br /> that the Article would include the parcel of land at 101 Red Brook Road, in response to the RFP issued <br /> one year ago by the Board of Selectmen seeking to establish a wireless tower in the area, to clear up <br /> any misconceptions about whether or not it was included in the Overlay District. Ms. Greelish <br /> inquired about the difference between a District and an Overlay and inquired why a commercial use <br /> would be allowed. Mr. Lehrer pointed out the Zoning Districts and Commercial Districts on the <br /> meeting room map and described the Overlay as an algorithm to identify appropriate parcels. Mr. <br /> Lehrer explained that the proposed Article would confirm and clarify 101 Red Brook Road as falling <br /> within the Overlay District. Mr. Balzarini stated that there was a need for a cell tower in the area and <br /> Mr. Lehrer reminded the Board that the DRI was under consideration with the Cape Cod Commission, <br /> and therefore, discussion about the project would not be appropriate. <br /> Terry Ronhock, 104 DeGrasse Road, was present, along with neighbors, to request that the Planning <br /> Board not recommend Article 14 at Town Meeting. As an abutter to the property, Ms. Ronhock <br /> expressed concern about the lack of transparency for the Article, reporting that she had received only <br /> one registered letter for the initial meeting in Mashpee, prior to the matter being forwarded to the Cape <br /> Cod Commission. No letters had been received from the Cape Cod Commission, despite being <br /> advised that they would receive notice. Additionally, no correspondence was received for tonight's <br /> meeting and they were unaware of the Article until they read the about it in the Enterprise on <br /> September 14. They also found no communication or information regarding the Planning Board's <br /> meeting. Ms. Ronhock stated that she and her.neighbors drafted a petition to request a meeting but as <br /> follow up, received a phone call from Mr. Lehrer that an October 3 meeting had in fact been planned. <br /> During the call, when Ms. Ronhock inquired why the meeting had not been posted in the Enterprise, <br /> Mr. Lehrer responded that it had been full and had instead been posted in the Cape Cod Times. Ms. <br /> Ronhock pointed out that all meetings were posted in the Enterprise, which was where residents looked <br /> to be informed about meetings. Ms. Ronhock added that they had been present at the previous <br /> meeting, where this meeting still had not been posted on the board, adding that the agenda had been <br /> stamped October 2. The Chair stated that, on the 27"', she announced that the meeting would occur on <br /> October 3. Ms. Ronhock asked again that the Planning Board not support the Article because the Cape <br /> Cod Commission would not be receiving their subcommittee report until October 18, which would be <br /> followed by a Public Hearing at the Cape Cod Commission before being reviewed by the Planning <br /> Board. Ms. Ronhock could not understand how the Planning Board could be able to approve a Zoning <br /> Bylaw change proposal, which could not be discussed. The Chair stated that she could not respond. It <br /> was Ms. Ronhock's opinion that the Planning Board had been elected to make decisions about Bylaw <br /> changes, noting that former Town Planner, Tom Fudala, had made it his goal to design a plan for the <br /> Town to protect the neighborhoods and natural wildlife areas. Ms. Ronhock expressed concern that <br /> the Selectmen proposed the Article, to contract a commercial space for Blue Sky Towers LLC. Ms. <br /> Ronhock stated that the location was in an R-3 Zone and within the boundaries of the Mashpee <br /> Wildlife Refuge and suggested that the proposed Article was an effort to spot re-zone the parcel into <br /> the Overlay District, which could set a precedent, and was as previously stated, already part of the <br /> Overlay. It was Ms. Ronhock's opinion that the Article was circumventing the power of the Planning <br /> Board and again asked that the Article not be recommended. <br /> 2 <br />
