6 <br /> Finance Committee <br /> Minutes <br /> August 28, 2018 <br /> Review of Draft October 15, 2018 Annual Town Meeting Warrant: (continued) <br /> Article #9: To adopt a Bylaw to prohibit the operation of recreational/non-medical marijuana <br /> establishments and marijuana retailers within the Town. As noted,this Bylaw prohibits the <br /> operation of all types of marijuana establishments within the Town of Mashpee. <br /> The purpose of this article is to enact a General Bylaw to ban all non-medical Recreational <br /> Marijuana Establishments as defined below within the Town of Mashpee. <br /> "Marijuana establishment", is defined to include all types of Marijuana establishments, including <br /> a marijuana cultivator, independent testing laboratory, marijuana product manufacturer, <br /> marijuana retailer or any other type of licensed marijuana-related business. <br /> The article was HELD for additional clarification. <br /> Article#10: Zoning Bylaw to limit the number of Marijuana Retailers and the location of <br /> Marijuana Establishments. Mashpee currently has (9) retail off-premises alcoholic beverage <br /> licenses. Twenty percent (20%) of the (9) licenses is 1.8. This would presently equal (1) <br /> location for the Town of Mashpee to allow the siting of a marijuana retailer. If the number of <br /> off-premises sale of alcoholic beverages should change,the number of allowed marijuana <br /> retailers would also change. <br /> The proposed Bylaw amendment would restrict a Marijuana Establishment use to the <br /> Commercial (C-1, C-2 or C-3) or Industrial (I-1) Districts upon issuance of a special permit. <br /> The article was HELD for additional clarification. A map would detail the areas. <br /> Article 911: This Bylaw amendment would establish the penalties for violating the Sign <br /> Bylaw. An amendment to the draft article would impose a fine per sign for the second, third and <br /> subsequent offense to enforce fairly and consistently. Currently, there are no penalties for <br /> violating the Zoning Bylaws regarding signs. <br /> Motion made by Mr. Avis to approve and recommend Article#ll as amended. <br /> Motion seconded by Mrs. Furbush. <br /> VOTE: Unanimous. 7-0. <br /> Roll Call Vote: <br /> Mr. Richardson,yes Mr. Pettengill,yes Mr. Ryan,yes <br /> Mr. Avis,yes Mr. McKelvey, yes Mr. McCahill, yes <br /> Mrs. Furbush,yes Opposed, none <br />
