WITHDRAWN-NOTICE Warrant Article 22: Swimming Pool Setbacks-The Board of <br /> Selectmen withdrew the Article. <br /> NOTICE Warrant Article 23/Warrant Article 21: Mixed Use Planned Development <br /> (MPD)-As the citizen petitioner, Chairman Waygan left the table and chairing the meeting was given <br /> to Vice Chair Cummings. Vice Chair Cummings read the Public Hearing Notice. No communications <br /> were received, including comment from Town Counsel. A letter from Mashpee Commons' Torn <br /> Ferronti had already been read. <br /> Mr. Fudala was recognized and stated that he wrote the Article one year ago, providing it to Chairman <br /> Waygan. For the record,Mr. Fudala stated that the Article was a result of discussions he heard while <br /> attending every meeting and visioning session with Mashpee Commons and incorporating aspects that <br /> would be amenable to the Planning Board, such as open space and affordable housing. Mr.Fudala <br /> clearly stated that in no way was his proposed Article a response to Mashpee Commons,but was an <br /> Article to assist Mashpee Commons with their plans for future development and submitted before <br /> Mashpee Commons' proposed FBC. Mr. Fudala suggested that there were some aspects that he would <br /> change but emphasized that it was never an anti-Mashpee Commons Article. <br /> Ashley Fisher,Mashpee Shellfish Constable, supported the Bylaw as it coincided with the Mashpee <br /> Comprehensive Wastewater Management Plan and incorporated water quality measures reducing <br /> nitrogen to 3 mglL, while also encouraging affordable housing and-open space. Ms. Fisher added that <br /> the Environmental Oversight Committee also supported the Article. <br /> Chairman Waygan returned to the table and announced her hope that Town Counsel would respond to <br /> a September 7 request for comments, related to two motions made by Selectman Gottlieb. Chairman <br /> Waygan stated that the Citizen Petition Article could not be withdrawn by her, except on the floor <br /> during Town Meeting. <br /> Chairman Waygan stated her wish not to close the Public Hearing for vote until October 3 to allow the <br /> Planning Board to further consider tonight's comments and review submitted documentation and <br /> review additional comments from Town Counsel. <br /> MOTION: Mr.Balzarini made a motion to continue the Public Hearing to October 3 at 7:45 <br /> p.m. Mr. Cummings seconded the motion. All voted unanimously. <br /> ROAD TAKING <br /> Discussion and vote on Warrant Article 22 to see if the Town will accept the layouts of <br /> Pierre Vernier Drive,Katian Way and Gunter's Lane in Pimlico Heights as public ways-The <br /> Chair stated that a vote would need to be taken before Town Meeting, so discussion should occur on <br /> October 3. Mr. Rowley confirmed that he had been in discussion with Ms. Laurent regarding the <br /> pians, noting that there was no mention of road monuments or bounds to identify the limits of the <br /> layout. Ms. Laurent would be following up with the engineer to have the bounds identified on the <br /> plan, if they had tied in to the monuments. <br /> 11 <br />
