Toirn of:1 lashpee <br /> Mashpee,..Alassachuscas 02649. <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2418-57 <br /> Petitioner, Katarina Kumbatiadis Doc.:4749068 <br /> (Owner of record: Brickyard Marketplace Ctf: #151204 <br /> Nominee Trust) <br /> 439 Nathan Ellis Highway, Unit 6 <br /> (Map 72 Parcel 23) <br /> Mashpee, MA 02649 <br /> A Petition was filed on October 24, 2018 by Petitioner, Katarina Kumbatiadis <br /> requesting a Special Permit under §174-25 E (7) of the Zoning Bylaws to allow for a dog <br /> grooming and dog day care business on property located in C2 Zoning District, (Map 72 <br /> Parcel 23), Mashpee, MA, (Owner of record: Brickyard Marketplace Nominee Trust). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on November 16, 2018 and November 23, <br /> 2018 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 12, 2018 at which time the following members of the Board of <br /> Appeals were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman, <br /> William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. <br /> Katarina represented herself for the Special Permit request. She said that her dog <br /> daycare business Captivating Canines has been running for over eight years by the former <br /> business owner that was never permitted. She took over the business thinking that all the <br /> permits were in place,but the Building Department could not find a Special Permit for the <br /> original established business. She provided the copy of the sign permit that was approved <br /> but there is no record of a special permit. <br /> Mr. Mendoza said this is a preexisting use, but there's no record of it going in front <br /> of the ZBA. If the Board sees fit to grant,the permit will go with the property. <br /> Mr.Furbush asked if the business has changed in any way since the previous owner. <br /> Katarina said that they will providing the same services. There will be no boarding <br /> of any dogs. <br /> 1 <br />
