COMMERCIAL LEASE <br /> THIS LEASE AGREEMENT made on the `-) day of __7y_Gh tt a"c/ , 2018, by <br /> and between Kevin Andrade,Trustee of Summerfield Park Realty Trust,with a mailing <br /> address of --- t gli_"74 ,Ad �y r�,��F'�. , Massachusetts az CM <br /> (hereinafter referred to as "Landlord") and CCE-CAT LLC 35 F South Street,Mashpee, MA <br /> 02649 (hereinafter referred to as "Tenant"). <br /> WITNESSETH.• That in consideration of the rents and covenants herein set forth, the <br /> Landlord hereby leases to the Tenant and the Tenant hereby rents from the Landlord, office space <br /> measuring approximately 3525 square feet, identified as Units 10 1,102 and 103 at 800 Falmouth <br /> Road Mashpee,MA 02649 (hereinafter called the"Leased Premises"). This Lease shall be <br /> subject to the terms and conditions as set forth:in this Indenture of Lease. <br /> 1. USE: <br /> The Tenant shall use the unit in conjunction and association with a marijuana dispensary <br /> business. This shall include the manufacture and sale of cannabis and cannabis related products. <br /> The tenant shall not use or permit the Leased Premises to be used for any other.business or <br /> purpose without written consent of the Landlord. <br /> 2. TERM: <br /> The term of this Lease shall be for a period of Five years commencing on January 2, 2019 <br /> and terminating on December 31,2024. Tenant will have two,three year options to extend this <br /> Lease past the above-mentioned term under the current terms and conditions contained in this <br /> Lease. Tenant shall give Landlord a ninety(90) day notice in advance of the expiration of the <br /> original three-year term and any extension periods entered into to iTiform Landlord of Tenants <br /> intent to exercise its option. Lack of proper notice shall constitute a forfeiture of Tenants right to <br /> extend. ** SEE PARAGRAPH 31 BELOW RELATIVE TO COMMENCEMENT OF LEASE <br /> AND RENTAL PAYMENTS. <br /> 3. RENT: <br /> The Tenant covenants and agrees to pay to Landlord, in equal monthly installments as <br /> rent for the Leased Premises during the term of said Lease, the suras as follows: <br /> Year 1: Payments to be made in accordance with Paragraph 31 herein; <br /> Year 2: $56,400 to be paid in equal monthly installments of$4,700; <br /> Year 3: $56,400 to be paid in equal monthly installments of$4,700;. <br /> Year 4: $59,925 to be paid in equal monthly installments of$4,993.75; <br /> Year 5: $59,925 to be paid in equal monthly installments of$4,993.75; <br /> Rent in option years shall increase by 3% annually. <br />
