DEPOSIT: Waived 30. APPLICABLE LAW: This Lease Agreement shall be construed under the laws of the Commonwealth of Massachusetts. 31. COMMENCEMENT OF LEASE AND RENTAL PAYMENTS For the first year of the lease term, Tenant shall make payments to the Landlord as follows: $1,175 due on February 1, 2019 and each month thereafter until the following occurs: $2,350 due each month, on or before the first of the month, to corrmen e 30 days after the Cannabis Control Commission's issuance of a provisional certificate of registration and notification of authorization to commence operations to Tenant, to continue until the following occurs: $4700 due each month, to commence on the first of the subsequent month following the Cannabis Control Commission's issuance of a final certificate of registration and notification of authorization to commence operations to Tenant. For the second and third years of this lease, Tenant shall pay Landlord lease payments of $4700 on or before the first of the month. For the fourth and fifth years of this Lease, Tenant shall pay Landlord lease payments of$4933.75 on or before the first of the month. In the event that tenant is unable to procure either initial permits or final permits, either party may terminate the lease and all rights and obligations shall become void. 32. NON COMPETE Landlord shall not lease any other unit located at 800 Falmouth Road, Mashpee, MA (Summerfield Park complex) to a business competing with Tenant's marijuana establishment.
