7 <br /> Board of Selectmen <br /> Minutes <br /> November 13, 2017 <br /> NEW BUSINESS <br /> Discussion and Approval of Popponesset Bay Intcr-municipal Agreement: (continued) <br /> Motion made by Selectman Cahalane to approve the Popponesset Bay Watershed Permitting <br /> pursuant to the Massachusetts Clean Waters Act Inter-municipal Agreement between the <br /> Towns of Barnstable, Mashpee and Sandwich, authorizing the Town Manager to execute the <br /> document as conditioned above. <br /> Motion seconded by Selectman Sherman. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman O'Hara,yes Selectman Cotton,yes Selectman Sherman,yes <br /> Selectman Cahalane,yes Selectman Gottlieb,yes Opposed, none <br /> This Agreement represents the first collaborative undertaking on the Cape where two towns jointly agree <br /> to a reasonable share of costs to assist the main beneficiary town to achieve compliance with the Clean <br /> Water Act by sharing a mutual goal to reduce nitrogen in Popponesset Bay through non-traditional <br /> nitrogen management approaches. <br /> The joint permit application will include provisions that Mashpee,the fiscal agent under this Agreement <br /> would implement its plan in 5-year blocks. Under this Agreement,the parties shall establish a working <br /> group comprised of membership from each town. The parties will individually continue to develop <br /> and/or implement its own Mass DEP approved CWMP or Targeted Watershed Management Plan. <br /> With the issuance of the permit, the implementation of the 20 year plan will begin, and credit will be <br /> applied to Mashpee for the shellfish initiative. <br /> Discussion and Approval of Memorandum of Understanding between the Town of Mashpee and the <br /> Town of Harwich: <br /> The Board of Selectmen reviewed the Memorandum of Understanding (MOU) between the Town <br /> of Mashpee and the Town of Harwich relative to the transfer of ownership of a 500 gallon Skidl Pump <br /> Forestry Unit to the Town of Harwich whereby the Town of Harwich would agree to provide <br /> forestry fire fighting assistance to the Town of Mashpee for Mutual Aid upon completion and <br /> availability of the vehicle. This is a surplus military vehicle. <br /> It was disclosed the document has been reviewed and revised with the assistance of Town Counsel who <br /> is deemed satisfied with the document which would be exempt from UPA procurement requirements. <br /> Thus the Board of Selectmen must authorize the MOU before it is executed by the Town Manager in his <br /> capacity as Chief Procurement Officer. <br />
