8. To establish and maintain a program of development impact fees <br /> P p under the <br /> applicable provisions of state law and county ordinances, to ensure that new <br /> development provides or contributes a fair share of the cost of, municipal <br /> infrastructure and services necessary to support it and that such infrastructure or <br /> funding is provided in a timely manner relative to the creation of1 ro'ect impacts. <br /> P P <br /> Section 15 of the cape Cod Commission Act, Chapter 7 15 of the e Acts of 1989, provides <br /> forte adoption of procedures for the municipalities within Barnstable County to <br /> calculate, assess and impose impact fees on proposed developments once a town's <br /> Local Comprehensive Plan has been adopted by Town Meeting <br /> and certified by the <br /> Commission. A draft Impact Fees Guidance Document has beenre ared b <br /> � P P Y the <br /> Commission to assist Towns in the development of an impact fee program. With 1 <br /> Mas pee's strong growth creating the demand for so many municipal facilities at one <br /> time, a impact fee program should be given strong consideration. <br /> The Guidance Document mentions that may be <br /> impact fees <br /> P y used to fund the <br /> expansion or construction of municipal facilities and infrastructure, with libraries of <br /> those facilities discussed in this element) being specifically mentioned. Impact fees <br /> are assessed for a specific use which has been created by a specific need the use of <br /> which has been identified in the Capital Facilities Element). They may not be used to <br /> Y <br /> replace infrastructure that serves only current population andast development. <br /> p p <br /> Impact fees will help shift the burden of paying for new capital facilities and <br /> infrastructure from municipalities to new development and offer arow a -as- ou- <br /> P Y Y g <br /> system for accommodating new development by contributing to "concurrent " <br /> Y <br /> management through the provisions and infrastructure. <br /> Impact fees are based on the Regional Policy Pian growth policy which "recommends <br /> that g p Y ds <br /> the rate of growth for any town should. not exceed the ability of that town to <br /> provide the services necessary to support that growth. New development should be <br /> required to pay its own way--i.e. to either provide or contribute to the provisions of the <br /> necessary facilities and infrastructure to manage the demands created by that <br /> development." This policy provides the basis for assuringthat never development <br /> p <br /> contributes its fair share to the construction of municipal buildings and facilities. <br /> 9. To coordinate the location and development of municipal and private buildings or <br /> facilities where appropriate to reduce municipal costs or further the accomplishment <br /> of the Town's goals and objectives. <br /> One way to generate alternative or non-property tax based sources of income may be <br /> i <br /> to coordinate the location and development of Town government functions with <br /> private services, an idea which should be given strop consideration. For example, <br /> . g <br /> the DPW Director has proposed a communications tower on the DPWro ert . This <br /> p P Y <br /> tower would give extra income to the Town, but it may impact the scenic value of the <br /> cemetery and Meetinghouse which are located south of the DPW facility. Therefore, <br /> , <br /> all proposals must take into account the "where appropriate" phrase of thisolic . <br /> p Y <br /> There are positive ways to meet this policy. Within Town the United States Post <br /> Office (a federal facility) has located in Mashpee Commons. The old Cit Hall in <br /> P y <br /> Lowell, Mass was specifically designed ned to house the municipal offices on the upper <br /> PPer <br /> two stories, the first floor being reserved for retail, whose rent payments were applied <br /> 27 <br />
