Summary of Legislation drafted by the Assembly of Delegates <br /> as of November 12, 1996 <br /> Section 1. (a) functions, duties & responsibilities for operation of jail, <br /> house of correction and courthouses transferred to State <br /> 1. (b) county government of Barnstable abolished <br /> Cape Cod Regional Government established within ' <br /> geographical boundaries of the county retaining all powers: ; <br /> Charter - Chapter 163 Acts of 1988 <br /> CCC Act - Chapter 716 Acts of 1989 <br /> Chapter 2 Acts of 1990 <br /> All Services Agreements remain in tact <br /> 1. (c) retain all powers under Chapter 34 and 140 - county government <br /> legal proceedings, hearings, suits, licenses, permits, etc. <br /> transferred to Cape Cod Regional Government; CC Reg. Gov't may apply for grants <br /> 1. (d) Cape Cod Regional Government may enter into agreements <br /> 1. (e) liabilities and debts of jail, house and courthouses as of July 1, <br /> 1997 are debts of the state <br /> state takes over leases and contracts pertaining 'to the jail, <br /> house of correction and courthouses as of 7/1/97 <br /> 1. (f) transferred to the state are (property) - courthouses, jail., house <br /> of correction, land on which they sit, parking facilities, fixtures and improvements <br /> thereon <br /> 1. (g) if jail is no longer used for corrections, town of Barnstable has <br /> oversight of use of buildings (this language being refined in cooperation with the <br /> Town of Barnstable) <br /> 1. (h) Superior -Courthouse is subject to a preservation restriction <br /> governed by Mass. Historical Commission, or other historical commission deemed <br /> appropriate, identifying specific characteristics, both interior and exterior, which should <br /> .be preserved <br /> 1. (i) personal property of county offices, meeting rooms, etc. .of <br /> county government is retained by Cape Cod Regional Government <br /> S <br />
