Henry Doc.: #1303827 <br /> 21 Kim Path Ct£: #210717 <br /> (Map 117 Parcel 265) <br /> Mashpee, MA 02649 <br /> A Petition was filed on January 2, 2019 by Owners, John Henry and Constance M. <br /> Henry requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for <br /> construction of a 16' x 20' deck on property located in the Popponesset Overlay District <br /> and R-3 Zoning District, at 21 Kim Path, Map 117 Parcel 265, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was.given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on January 4, 2019 and January 11, 2019 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 23, 2019 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ron Bonvie, Scott Goldstein,Norman J. Gould, and Associate Member, <br /> Sharon Sangeleer. Also present was Building Commissioner, Michael Mendoza. <br /> Mark Clancy, with Clancy & Castano represented the applicants, and will be <br /> builder for the deckproject. The deck is off the rear of the house which is 24 ft. from the <br /> left side of the structure, and 26 ft. from the right side, of the structure, and 80+ feet from <br /> the rear property line. He said the lot coverage is currently 9.32%and proposed is 12.16%. <br /> The Board requested that the existing and proposed lot coverage to be written on <br /> the site plan,with a current date and initialed by the builder. <br /> Mr. Furbush read the Conservation and Inspection Department comments into the <br /> record. No comments from Board of Health. <br /> There were no more comments from the Board or audience. <br /> 1 <br />
