i Uolun of <br /> P. 0, BOX 1 108 <br /> MASHPEE, MA 02649 <br /> PLANNING BOARD MINUTES : 1/16/85 P. 4 <br /> George Benway appeared before the Board representing Popponessett Realty <br /> T-last with a plan he had submitted on January 2nd . He presented a master <br /> plan of Simon's Narrows Rd . showing Popponessett Realty Trust property <br /> with that of Mashpee Investors abutting . However he said -the Popponessett <br /> Trust property has been revised . <br /> The Board discussed the cul-de-sac to Part B and the lack of oepn space . <br /> Ms . Tanneyhill, representing the Historical Commission said the Commission <br /> would like to gon record as being opposed to the cutting off of Simon's <br /> Narrows Rd. by this proposed development as Simon's Narrows Rd . gives <br /> access to Shoe String Bay. Mr. Benway said the Assessor's map shows it <br /> with the line he 's shown and they haven't changed the road at all. <br /> Ms . Tanneyhill said older maps show the road going to the water. Mr. <br /> Fudala said the tax maps have been changed in the past2 years . <br /> Mr. Dubin said there had been no abandonment procedure and felt it wasn't <br /> good policy to approve the plan with the property line accross it . He <br /> said it should show where the pavement was . <br /> A representative of the Mashpee Neck Association said as far as he could <br /> remember the road went directly to the water. He said they would not want <br /> any rights taken away from them and would like to see the same rights when <br /> the development is finished. <br /> Mr. Fudala presented a 1962 map which showed it as a public way to the <br /> water and no property line . Mr. Dubin asked Mr. Benway if from his point <br /> of view, is there any negative opinion from eliminating the line . Mr. <br /> Benway said he has none but he would check with counsel. <br /> Mr. Dubin said he would like to see that line eliminated as earlier maps <br /> don't show it and the existing pavement protrudes beyond that line shown <br /> on this plan. He said the final plan should show what kind of road it is <br /> and if the public has rights over it , they would have rights over the road <br /> but not parking rights . <br /> Ms . Tanneyhill brought up the status of Bryant 's Cove Rd . Mr. Dubin said it 's <br /> not a public road and it 's never been treated as such; from the Planning <br /> Board 's point of view, it 's a traveled ancient way. <br /> The Board made the following recommendations : <br /> The plan needs more open space <br /> eliminate cul-de-sac in Part B and tie in with Yardham Dr. <br /> relocation of Bryan'ts Cove Rd . would have to be superior to present one . <br /> something done with curve at lots 13 ,14&19. <br />
