The Chair referenced the last meeting when Mr. Mooney's letter was reviewed along with the <br /> Covenant. The Chair referenced the first paragraph in the Covenant that required written notice <br /> that work had been completed, noting that she had requested that a revised letter be submitted. <br /> Mr. Mooney did not realize his letter was not sufficient so the Chair suggested that he date an <br /> amendment,Notice of Completion of Work, on a copy of the letter he submitted. The <br /> amendment would then legally kick off a 30-day period of review. It was noted that an <br /> inspection had already been completed by Mr. Rowley. <br /> It was confirmed that Mr. Mooney had received a copy of Mr. Rowley's report. Mr. Rowley <br /> reported that he had reviewed the comprehensive landscaping plans for the Phase III project. <br /> Mr. Rowley reported difficulty with comparing the plans to what appeared on site, noting that it <br /> was evident that substantial landscaping was completed throughout the property, maintained and <br /> in good condition. It was Mr. Rowley's opinion that the landscaping was insubstantial <br /> compliance with the plan and there was no reason to hold on to the security. Mr. Rowley <br /> confirmed that the plans were dated 2003/2004. <br /> The Chair inquired about landscaping for the dumpsters, noted as a complaint in 2005. Mr. <br /> Mooney responded that the dumpsters were new with enclosures constructed around them. Mr. <br /> Rowley confirmed that it was possible there would be changes in the 13 years since the last walk <br /> through, and replacements were likely throughout the entire community. Mr. Rowley also <br /> confirmed for the Chair that the Crescent conditions were as planned, though it was likely the tall <br /> singular pines would require removal and replacement in the future. Mr. Mooney noted that <br /> irrigation was added to the area, at a cost of$10,000. The Chair referenced the previous minutes <br /> from 2011 and Mr. Lehrer confirmed that he had a follow up meeting with Mr. Mooney. Mr. <br /> Mooney confirmed that all of the work was completed regarding the dead trees. The Chair <br /> confirmed that the tree removal process was still in place regarding tree work and Mr. Mooney <br /> agreed that the process was still in place. It was noted that the Witten Landscaping invoice <br /> reflected the work completed at Crescent. <br /> MOTION: Mr. Balzarini made a motion to reduce the Subdivision Performance <br /> Guarantee of Windehime Point Condominium cash deposit of$20,000, plus interest, be <br /> returned to the Windehime Point Condominium and that the whole Guarantee be reduced <br /> to zero dollar amount. Mr. Weeden seconded the motion. 3 voted yes, I abstained <br /> Planning Board members signed the documents. <br /> Consideration & Possible Action to Accept Performance Bond for Remaining <br /> Roadway Construction to be Completed at Ockway Highlands for Lot Releases-Mr. Lehrer <br /> referenced Town Counsel's comments on the draft agreement and confirmed that Town Counsel <br /> approved the Tripartite Agreement for signature. Mr. Lehrer noted that the lender would be <br /> setting aside an amount from the loan that would be withheld from the applicant,to be used by <br /> the Planning Board should the project proponent default on their responsibilities. Mr. Lehrer <br /> confirmed that the document would take the place of the Covenant. There was discussion <br /> regarding the identification of a date of completion. It was noted that the top coat likely would <br /> not be placed until the majority of homes were constructed. Mr. Balzarini recommended having <br /> 4 <br />
