(enclosure: <br /> memorandum of 3/25/19) <br /> In February, the Town of Mashpee entered into a contract with Barnstable County to use the <br /> Country dredge. All requirements were met to perform the dredge to not encroach upon an Avian <br /> Time of Year (TOY) Restriction effective April 1, 2019. TOY Restrictions are state and federally <br /> controlled. <br /> There were assurances from Barnstable County the dredging project would be given full attention, <br /> and be completed by April 1St. It is March 25" and the project has not started. It was noted there <br /> has been numerous equipment failures and personnel changes. The dredge equipment is owned <br /> and maintained by the County, and breakdowns are the responsibility of the County. <br /> With regards to the Popponesset Approach Channel,the Town of Mashpee has planned <br /> appropriately and it is imperative the dredge be completed. <br /> It is anticipated that repairs to the new dredge, "The Sand Shifter"currently sited in Chatham will <br /> take approximately 4-6 weeks. There is hope the dredge situated in the Town of Falmouth would <br /> be earmarked for Mashpee thereafter. Mr. Bates indicated that Barnstable County is also <br /> negotiating with an additional dredge firm to complete necessary projects on the Cape and, in the <br /> interim Mr. Bates is seeking assistance from other dredge operation firms. <br /> Notification has been given to state and federal regulating agencies; however there is concern with <br /> respect to the April 1St deadline as it is difficult to request an extension with an unknown start and <br /> an unknown completion date. There is possible amnesty for up to 15 days. <br /> 7 <br />
