*DRAFT#1* OCTOBER 21, 2019 Annual Town Meeting warrant <br /> Explanation:This Article will create and fund an account that will make the process easier to manage <br /> for the engineering, permitting, dredging and associated expenses for the Town's waterways. <br /> Article <br /> To see if the Town will vote to appropriate and transfer the sum of $34,500.00 from the Channel <br /> Permit Account to the Engineering/Permitting/Dredging and Associated Expenses Account, or take <br /> any other action relating thereto. <br /> Submitted by the Waterways Commission <br /> Explanation: This Article will transfer monies in to the waterways account created in the previous <br /> article. <br /> Article <br /> To see if the Town will vote to add the following."Promulgation of Regulations" paragraph directly <br /> after the "WATERWAYS USE OF" heading and before Chapter 170-1 "Definitions" paragraph the <br /> following: <br /> Chapter 170—A. Promulgation of Regulations. <br /> A. After public notice and public hearing, the Board of Selectmen shall promulgate rules and <br /> regulations to effectuate the purpose of this article. Notice shall be given at least two weel<s <br /> prior to the public hearing by publication in a newspaper of general circulation in the Town <br /> and by posting with the Town Clerl< and posting in the Harbormasters office. <br /> B. These regulations shall define !<ey terms and. establish procedures for all waterways related <br /> uses including registration of. moorings, assignment of mooring space, establishment and <br /> maintenance of a waiting Iist, inspection of moorings, specifications for moorings, <br /> identification of moorings and assignment and collection of fees. <br /> C. Failure by the Board. of Selectmen to promulgate such rules and regulations or a legal <br /> declaration of their invalidity by a court of law shall not act to suspend or invalidate the <br /> effects of this article. <br /> D. After public notice and public hearing, the Board of Selectmen may amend or otherwise <br /> modifythese rules and regulations. Notice shall be given at least two weeks priorto the public <br /> hearing by publication in a. newspaper of general circulation in the Town and by posting with <br /> the Town Clerk and posting at the Harbormasters office. <br /> Submitted by the waterways Commission <br /> Explanation: This article will greatly reduce the amount of time it presently takes to make any <br /> changes to our Waterways Bylaws and keeps the changes out in front of the interested public. <br /> 6 <br />
