The <br /> Town of Falmouth has a bylaw with the same wording and the Commonwealth of Massachusetts will <br /> not enforce the Falmouth bylaw unless Mashpee also has a similar bylaw. Ashumet Pond is bordered <br /> by both Mashpee and Falmouth. <br /> Article <br /> To see of the Town will vote to amend Chapter 172-4{B}{3} of the General Bylaw as follows: <br /> Amend the language of Subsection (B)(3) as follows.- <br /> Replace <br /> ollows:Replace the phrase "as prescribed in 310 CMR 280.21 through 280.25" with "as prescribed in 310 <br /> CMR 10.05(4).. <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Department <br /> Explanation: The existing wording makes reference to 310 CMR 280.21 through 280.25. This is an <br /> incorrect regulatory citation. The correct regulatory citation in the Massachusetts State Wetlands <br /> Protection Act is 31.0 CMR 10.05(4) <br /> Article <br /> To see if the Town will vote to amend Chapter 172-5 of the General Bylaws as follows: <br /> Amend the language of subsection (A)(1) as follows: <br /> Replace the phrase "an Administrative Review Level.2"with "a permit" <br /> Preface the existing language of Subsection (A)(2) with the following: <br /> "Any person filing a Notice of Intent application and/or a request for an Amended order of <br /> Conditions with the Commission must, after being given written notice by the Commission of the <br /> time and date of the required hearing, notify all abutting property owners within 100 feet of the <br /> boundary of the property on which the work is proposed, according to the most recent records of <br /> the Assessors, including owners in another municipality" <br /> or take any other action relating thereto. <br /> Submitted by the Conservation Department <br /> 7 <br />
